Member Information has the meaning set forth in Section 10.3(c) of this Agreement.

Member Information means all information, data, knowledge and know-how, in whatever form and however communicated (including, without limitation, Confidential Information but excluding the Existing Data), which, as shown by written records, was developed, conceived, originated or obtained by a Member: (1) before entering into this Agreement, or (2) independent of its performance under the terms of this Agreement.

More Definitions of Member Information

Member Information means any records containing nonpublic personal information, as defined in 12 CFR 716.3(q), about a mem- ber, whether in paper, electronic, or other form, that is maintained by or on behalf of the credit union.

Member Information means any non-public, personally identifiable information about a Member, including any combination of a Member’s name plus any of his or her social security number, driver’s license or other identification number or credit or debit card number, or other account number utilized by a Service Provider, revealed by or through a Disclosing Party to a Receiving Party.

Member Information means a Member’s nonpublic proprietary information.

Member Information all information and data uploaded, loaded onto, transmitted via or otherwise provided to IPSX Facilities by the Member including but not limited to all:

Member Information shall include: (i) individually identifiable health information, deemed protected health information (“PHI”) under applicable regulations promulgated under the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), Public Law 104-191, as amended from time to time and particularly Title II, Subtitle F (Administrative Simplification) thereof (42 U.S.C. §§ 1171 et. seq.), such as information relating to treatment, medical condition or payment for health care services of the member; and (ii) non-public personal information (“NPPI”) under the Gramm Xxxxx BIiley Act and applicable state law and/or regulations, as amended from time to time, such as, but not limited to, Member identification numbers, addresses, or phone numbers. Agent agrees to obtain such necessary authorizations and to enter into all necessary agreements in connection with the use or disclosure of Member Information. Agent agrees not to further disclose Member Information without the Member's authorization. Agent further agrees not to make any changes to any application enrollment forms, statements of health or any other forms or documents provided by individuals or their eligible dependents in connection with enrollment in AvMed health benefits products.
