Work Out of Grade. A. Any Officer covered by this Agreement being paid D-1 salary who is directed to perform substantially all the duties and assumes substantially all the responsibilities of a Field Training Officer for two (2) or more hours within a single eight (8)-hour tour of duty, shall be paid at a D-2 rate consistent with his or her own tenure for an eight (8) hour tour of duty, or for the time spent, whichever is greater. Any Officer covered by this Agreement being paid D-1 or D-2 salary who is directed to perform substantially all the duties and assumes substantially all the responsibilities of Sergeant (other than in the Internal Affairs Division, Training Division, or Research and Development Division) or a Forensic Investigator for more than two (2) hours within a single eight (8)-hour tour of duty, shall be paid at a D-3 rate consistent with his or her own tenure for an eight (8)-hour tour of duty, or for the time spent, whichever is greater.
Work Out of Grade. Any Captain covered by this Agreement who is directed to perform substantially all of the duties and assumes substantially all of the responsibilities of a Commander (D-6) for two (2) or more hours within a single eight- (8-) hour tour of duty shall be paid at the appropriate D-6 rate for an eight- (8-) hour tour of duty. Any Captain covered by this Agreement who is directed to perform substantially all of the duties and assumes substantially all of the responsibilities of a Commander (D-6) shall be paid at the appropriate D-6 rate for the first eight (8) hours worked. If a Captain is required to work overtime, the Captain will be compensated at the D-5 rate consistent with the provisions of Section 20.2.
Work Out of Grade. When a member of the Union is assigned in writing by his/her supervisor to substitute for an employee in the bargaining unit holding a higher classification who is absent for any reason, and such member of the bargaining unit works in such higher classification for ten (10) or more consecutive working days, such employee shall be paid, retroactive to the first of such consecutive days worked, at the pay grade step of the higher classification that is next higher than such member’s then current wage. Work Out of Grade. Any Lieutenant in District Law Enforcement covered by this Agreement who is directed to perform substantially all of the duties and assumes substantially all of the responsibilities of a Captain (E-5) in District Law Enforcement for two (2) or more hours within a single tour of duty shall be paid at the E-5 rate for the tour of duty. If a Lieutenant is required to work overtime while working out of grade at the E-5 rate, the Lieutenant will be compensated at the E-5 rate for each hour worked and also be compensated at the E-4 rate consistent with the provisions of Section 20.2. Work Out of Grade. Whenever an employee is required to perform the work of an employee of higher rank, such employee’s compensation shall, for so long as he/she performs such work, be computed as if such employee regularly received the rate of compensation applicable to the higher ranked employee. This provision shall apply to all such work performed, whether performed during regular or overtime working hours.

Work Out of Grade. An employee who is temporarily assigned to perform the duties and responsibilities of an absent employee for a period of over five (5) consecutive days shall be paid, retroactive to the first day, at step one of the classification of the position being filled or a ten percent (10%) differential over their current base salary, whichever is greater. Out of grade pay shall have no impact on incentive pay, merit pay or other differentials received by the replacing employee in his/her regular position.

  • Critical Milestones (a) Subject to the provisions of Section 3.1(c), commencing on the Effective Date, Seller shall develop the Facility in order to achieve the following milestones (“Critical Milestones”) on or before the date set forth in this Section 3.1(a):

  • Project Specific Milestones In addition to the milestones stated in Section 212.5 of the Tariff, as applicable, during the term of this ISA, Interconnection Customer shall ensure that it meets each of the following development milestones:

  • Project/Milestones Taxpayer develops and manufactures various products for use in the defense, aerospace and security industries. In consideration for the Credit, Taxpayer agrees to expand its operations at various locations throughout California, including El Segundo, Redondo Beach, Palmdale, Sunnyvale, Woodland Hills, Azusa and Rancho Xxxxxxxx. As part of its expansion, Taxpayer will invest in manufacturing equipment, computer and electrical equipment and make tenant improvements to the above facilities. Additionally, Taxpayer will hire full-time employees as part of its expansion (collectively, the “Project”). Further, Taxpayer agrees to satisfy the milestones as described in Exhibit “A” (“Milestones”) and must maintain Milestones for a minimum of three (3) taxable years thereafter. In the event Taxpayer employs more than the number of Full- time employees, determined on an annual full-time equivalent basis, than required in Exhibit A, for purposes of satisfying the “Minimum Annual Salary of California Full-time Employees Hired” and the “Cumulative Average Annual Salary of California Full-time Employees Hired,” Taxpayer may use the salaries of any of the Full-time employees hired and retained within the required time period. For purposes of calculating the “Minimum Annual Salary of California Full-time Employees Hired” and the “Cumulative Average Annual Salary of California Full-time Employees Hired,” the salary of any full-time employee that is not employed by the taxpayer for the entire taxable year shall be annualized. In addition, Xxxxxxxx agrees that any full-time employee hired after the effective date of this agreement that is a “qualified full-time employee” (as defined in RTC section 23636) shall be excluded from the calculation of the net increase of full-time employees required by this Agreement if Taxpayer claims the credit allowed by RTC section 23636.

  • Length of Work Year 1. The length of the work year for custodians, accountants, (excluding school lunch accountant), personnel specialist, maintenance, maintenance helpers, mechanics, purchasing coordinator, county receptionist, warehouse and property records coordinator shall be twelve months.

  • Cost of Work The Cost of Work will be adjusted and finalized as part of the Contract Sum in the GMP. The budget for the Cost of Work shall not exceed Five Million Three Hundred Six Thousand Eight Hundred Five and No/100 Dollars ($5,306,805.00).

  • Length of Work Day The regular employee work day shall be no more than seven (7) hours forty (40) minutes including the duty-free lunch period of thirty (30) continuous minutes.

  • Service Rates The rates for services provided to a specific child by the Provider shall be set forth in the PSO for the child. The Provider may not increase the rate for any service described in a PSO during the term of the PSO unless the PSO provides for an automatic rate increase option, in which case the rate may only be increased in the initial month of the Buyer’s fiscal year and must be agreed to in writing by the Buyer. The provider is required to have all services and rate information entered and up-to-date in the Service Fee Directory by the beginning of the contract year. The Provider shall provide to the Buyer written notice of any planned rate increase (90 days) prior to the initial month of the Buyer’s next fiscal year. Such written notice shall contain the justification for the increase and shall be submitted in triplicate to the Buyer’s Children’s Services Act Manager.

  • Project Schedule Construction must begin within 30 days of the date set forth in Appendix A, Page 2, for the start of construction, or this Agreement may become null and void, at the sole discretion of the Director. However, the Recipient may apply to the Director in writing for an extension of the date to initiate construction. The Recipient shall specify the reasons for the delay in the start of construction and provide the Director with a new start of construction date. The Director will review such requests for extensions and may extend the start date, providing that the Project can be completed within a reasonable time frame.

  • Contract Goals A. For purposes of this procurement, OGS conducted a comprehensive search and determined that the Contract does not offer sufficient opportunities to set goals for participation by MWBEs as subcontractors, service providers, or suppliers to Contractor. Contractor is, however, encouraged to make every good faith effort to promote and assist the participation of MWBEs on this Contract for the provision of services and materials.
