Fire Chief. A formal written grievance shall be presented to the Fire Chief within thirty (30) calendar days of the date the grievant or Union knew or reasonably should have known about the actions and/or circumstances giving rise to the grievance. The Fire Chief shall investigate the grievance and meet with the grievant and Union representatives within fifteen (15) calendar days following presentation of the grievance at Step 1. The Fire Chief shall respond in writing to the grievance within five (5) calendar days following the Step 1 grievance meeting.

Fire Chief. If the grievance is not resolved in Step 1, the employee or his representative shall present a written grievance to the Fire Chief or his designee within fourteen (14) calendar days from the response to the grievance from the Administrative Assistant Chief. The Fire Chief or his designee shall conduct a hearing and issue a response, in writing, within fourteen (14) calendar days from the receipt of the grievance.
Fire Chief. If a mutually acceptable solution has not been reached at Step 1 or 2 of the Formal Grievance Procedure, CWA, Local 9588 or the grievant shall submit the written grievance to the Fire Chief within five (5) working days of the receipt of written response of the Human Resources Director or designee. The Fire Chief shall call for a conference within a reasonable period of time, not to exceed twenty (20) working days, to allow for full discussion of the grievance with the parties involved and their representatives. Within fourteen (14) working days of the meeting, the Fire Chief shall give a written decision to the employee. If the employee is not satisfied with the decision of the Fire Chief, the employee may proceed to the next step. Step 4 – Pre-Arbitration Process. If a grievance has not been satisfactorily resolved at Step 3, a written appeal to arbitration must be filed with the Human Resources Director or designee and by CWA, Local 9588 within five (5) working days of notification of the decision by the Fire Chief. The appeal must be presented on the aforementioned grievance form along with a copy of any pertinent documents and must state that a resolution of the issue was unattainable through the informal and formal procedures through Step 3 and a formal hearing is now requested. Grievances shall only be advanced to arbitration with the agreement of the Union. The cost for hearing all grievances advanced to arbitration shall be split equally between County Fire and the Union including any cancellation fee if both parties are mutually responsible, otherwise the party responsible shall pay the entire cancellation fee. Pre-arbitration conferences are to be mandatory and no grievances shall be forwarded to the arbitration process without the pre-arbitration hearing conference. Within twenty (20) working days of the approval to advance a grievance to arbitration, both parties are required to meet for a pre-arbitration hearing conference with the goal of resolving mutually identified grievance issues. If resolution is not attained, both parties are obligated at that time to jointly or individually declare stipulations, identify witnesses and exchange exhibits that will be carried forward to the arbitration process, the intent being full disclosure by both sides prior to the arbitration process.
Fire Chief. Grievances submitted at Step 1 will be filed with the Fire Chief. There will be a mandatory meeting to discuss the grievance. The Fire Chief will respond in writing to the grievant or his or her Association representative within ten (10) business days of receipt.

City will coordinate this process with the grievant.
Fire Chief. The Fire Chief shall be an employee of the City under the direction of the Mayor. It is understood that the authority to hire, discipline, commend, or terminate the Fire Chief is the Mayor’s. However, inasmuch as the Fire Chief is the primary contact and administrator of services provided to the District, it is in the interest of both parties to allow input into the process of hiring, discipline, commendation, or termination of the Chief. The Mayor shall include the district commissioners, to the extent possible, in the interview process for hiring any new Chief, and shall also include the commissioners in the performance evaluation process by meeting with the district commissioners at least annually to discuss the position and performance of the Fire Chief. Any input by the commissioners may be used in making decisions. The content of any discussion shall remain confidential due to the personnel nature of the discussion. The elected officials shall be notified of any significant decisions regarding the hiring, discipline, commendation, or termination of the Fire Chief prior to the information becoming public.
Fire Chief. Within ten (10) days, if the grievant is not satisfied with the disposition of their grievance at level one (1), they shall file the written grievance with the Fire Chief. The Chief shall hear the appeal and render their written decision within ten (10) days after receiving the grievance.
Fire Chief and Union President shall mutually appoint one member from each rank (Firefighter- Commander) to serve on the safety committee on an annual basis.
Fire Chief. If the grievance is not resolved at Step 1 the grievant may, within ten (10) working days following receipt of the Step 1 answer or the Fire Chief’s rejection of the Step 1 recommendation, whichever is later, file a written appeal with the Fire Chief or designee. The Fire Chief, or the Chief’s designee, shall hold a grievance meeting with the grievant and an Executive Board member and/or an attorney within ten (10) working days following receipt of the written grievance unless otherwise agreed to by the parties. The Fire Chief or the Chief’s designee shall investigate the facts and reply to the filing party in writing within ten (10) working days after a meeting. If the grievance is not appealed to the Step 3 by the filing party within ten (10) working days after receipt of the Fire Chief’s answer, it shall be considered to be satisfactorily resolved.
