Monitoring of the Agreement. Plaintiffs’ Counsel and the Regional Administrator shall be solely responsible for monitoring this Settlement Agreement. Under no circumstances shall HUD and/or the Local Parties be required to fund any of Plaintiffs’ Counsel’s and/or the Regional Administrator’s monitoring efforts and/or monitoring attorney’s fees incurred after the Execution Date of this Agreement.

Monitoring of the Agreement. Each Signatory Association will have the responsibility for systematically monitoring and evaluating the implementation of this Agreement. Each Signatory Association will report annually to the other Signatory Associations on the number of applications received from each Signatory Association, including information on the number of applications accepted for certification, full membership or eligibility for certification or full membership, the number not approved and, if the policies and procedures of the Association and the law of the country permits, the reasons for their not being approved. Information on the monitoring and evaluation may be shared with other interested parties on request, if the policies and procedures of the Association and the law of the country permits.
Monitoring of the Agreement. The application of this Agreement in one or several Danone companies shall not override pre-existing situations that are more favourable to employees, whether derived from national laws, the application of a collective agreement at national or any other level, or pre-existing custom at the site. Danone and IUF agree to the establishment of joint monitoring of this Agreement in the Group companies. This monitoring shall consist of at least one annual specifial meeting of the IUF/Danone Steering Committee to analyse the following indicators which will be included in the annual report of financial and social indicators to all the CIC members: • Number of accidents per business; • Accident frequency rate; • Accident severity rate; • Social welfare cover rate; • Number of cases of occupational illness; • Percentage of yearly appraisal interviews performed; • Percentage of sites having a specific health, safety and working conditions body with staff representation; • Percentage of sites having a medical monitoring unit. • Number of companies having an agreement or plan on prevention of stress and psycho-social risks. Best practices reported to the Steering Committee shall be the subject of a presentation to the C.I.C. Exchange of best practice among sites or companies, both at management and staff representative levels, shall be encouraged. Any trade union or company management shall be entitled, via the appropriate channels (IUF for trade unions), to submit the matter to the Agreement Interpretation Committee if it considers that one or several provisions of this Agreement present a difficulty of application. The actual dispositions concerned must be clearly indicated. The Danone/IUF Steering Committee shall act as the Interpretation Committee. Should the findings be unanimously arrived at, they shall become enforceable. In the opposite case, each party shall remain free to act as it sees fit, subject to the provisions of this Agreement.

Monitoring of the Agreement. 9.1 The continuous monitoring of the GMP compliance programmes determined to be equivalent at the conclusion of the confidence building period and any subsequent decisions concerning that equivalence must be made according to a mutually developed and managed equivalence maintenance programme. This programme will be managed by the Joint Sectoral Group.
Monitoring of the Agreement. The continuous monitoring of the equivalency of designation processes and conformity assessments for each Party’s requirements that have been determined to be equivalent at the conclusion of the confidence building programme, and any subsequent decisions concerning that equivalence, must be made according to mutually developed and managed equivalence maintenance and implementation activities. The Parties will undertake to hold regular consultations, within the joint sectoral group set up under this Annex to ensure the continued relevancy and accuracy of this Annex. The regulatory/designating authorities and conformity assessment bodies will organise meetings to discuss specific questions and issues. Conformity assessment bodies and regulatory/designating authorities must continue participation in maintenance activities, as established by the joint sectoral group, within the framework of this Annex in order to maintain their status under this Annex as indicated in Attachment II. Parties may request the addition of regulatory/designating authorities or conformity assessment bodies to Attachment II. The procedure for the acceptance of new regulatory/designating authorities will be as described in the confidence building programme. Conformity assessment bodies will be added to Attachment II upon recommendation from a regulatory/designating authority and joint decision by the joint sectoral group.
