Liability for Personnel. 5.7.1. The Concessionaire shall be solely responsible for complying with all statutory responsibilities and liabilities in respect of the personnel engaged by him and liable for obtaining all mandatory registrations and deposit of contributions under various enactments. If, on account of default of the Concessionaire Authority is compelled to make any payments/contributions or discharge any responsibility/liability of the Concessionaire, Authority shall be entitled to recover and/or set off such amounts/expenses incurred from the amounts due to the Concessionaire without prejudice to the right of Authority to initiate appropriate legal proceedings for recovery of such amounts. The Concessionaire shall indemnify the Authority against all claims whatsoever arising out of his default in respect of the personnel engaged by him under any Statute/Law in force.
Liability for Personnel a) All persons employed by the custom xxxxxx shall be treated as his own employees/servants in all respects and the responsibility under the Indian Factories Act or Employees Provident Fund Act or any such other Statute applicable to all such personnel shall be liability of the custom xxxxxx.
Liability for Personnel. (a) All persons employed by the Bidder shall be engaged by him as his own employees/workers in all respects and all rights and liabilities under the Indian Factories Act, the Employees Compensation Act, Employees Provident Fund & Miscellaneous Provisions Act (EPF & MP Act), Industrial Disputes Act, Contract Labour (R&A) Act and under all other applicable enactments in respect of all such personnel shall exclusively be that of the Bidder. The Bidder shall be bound to indemnify FCI against all the claims whatsoever in respect of his personnel under the Employees Compensation Act, 1923 or any statutory modification thereof or otherwise for or in respect of any damage or compensation payable in consequence of any accident or injury sustained by any workmen or other person whether in employment of the Bidder or not.

(a) All persons employed by the Contractor shall be engaged by him as own employees in all respect, and all right and liabilities under the Indian factories Act, or the Workmen’s Compensation Act, or Employees provident fund Act, and other applicable enactments, in respect of all such personnel shall exclusively be that of the contractor. The Contractor shall be bound to indemnify the Corporation against all the claims whatsoever in respect of its personnel under the workmen’s Compensation Act, 1923 or any statutory modification thereof or otherwise for or in respect of any damage or compensation payable in consequence of any accident or injury sustained by any workmen or other person whether in employment of the contractor or not.
Liability for Personnel. Supplier is fully responsible for all acts and omissions of Personnel (howsoever arising) in the performance of the Work and Supplier shall be liable for all acts and omissions of the Personnel as if they were acts or omissions of Supplier. Supplier shall indemnify Arm for any expense, liability, loss, claim or proceedings however arising, whether during or after the expiry or termination of all or any part of the Work, incurred by Arm as a result of (i) the employment or termination of employment of any Personnel, or any other person that claims to be Personnel, or (ii) any assertion or claim that the provision of Work has or is likely to give rise to a relevant Transfer (iii) any employment-related claim or any claim based on worker or employee status (including reasonable costs and expenses) brought by any Personnel against Arm in connection with the provision of the Work; and (iv) any income tax or any other liability, deduction, contribution, assessment or claim arising from or made in connection with the provision of Work or any payments or benefits received by Personnel for the Work.
Liability for Personnel. 5.12.1 The Service Provider shall be solely responsible for complying with all Applicable Laws in respect of the personnel engaged by the Service Provider including without limitation obtaining all Applicable Permits, registrations and / or for the deposit of payments / contributions under all Applicable Laws. In the event, that the Service Provider does not make timely payments / contributions as may be required in relation to the personnel employed by the Service Provider in accordance with the requirements of all Applicable Permits and / or Applicable Laws, the Authority may, at its sole discretion, make such contribution / payment to the relevant Governmental Instrumentalities. In the event, that the Authority has made any contribution / payment in relation to personnel employed by the Service Provider in accordance with the requirements of all Applicable Permits and / or Applicable Laws, the Service Provider shall reimburse all such contributions / payments to the Authority, immediately and in no event later than 15 (fifteen) days from the date of the demand notice as issued by the Authority to the Service Provider in this regard. The Service Provider will indemnify, defend, save and hold harmless the Authority and its officers, servants, agents and / or representatives against any and all suits, proceedings, actions, demands and third party claims for any loss, damage, cost and expense of whatever kind and nature, whether arising out of any breach and / or default by the Service Provider of any of its obligations, under this Agreement and / or under Applicable Laws, in relation to any personnel engaged by the Service Provider.

All persons employed by the contractor(s) shall be engaged by them/him as his/their own employees in all respects and the responsibilities/obligation under contract Labour (R&R) Act 1970, the Indian Factory Act, the Workmen Compensation Act, Employees Provident Fund Act, and under Minimum Wages Act and various other statutory enactments shall be that of the contractor. The contractor shall indemnify EXIM BANK against all the claims whatsoever in respect of the said personnel and Workmen Compensation Act, EPF Act, ESI Act, or any other statutory/Provisions or otherwise in respect of any damage, penalty, compensation, interest, fines payable in consequence of any accident or injury sustained by any worker of the contractor. The contactor shall co-ordinate with ESI authorities to get the family treatment card for security guards.

The Agreement as entered into between the Authority and the Concessionaire shall in no way nullify, reduce, mitigate or absolve the parties of any responsibility, obligation or liability that may devolve upon them under any statutory/mandatory provisions prevailing in India. Liabilities of the Concessionaire in respect of obligatory laws remain unaffected and Concessionaire shall remain responsible for settlement of claims, if any, of third parties who may suffer damages either due to the fault of the Concessionaire or its employees and Associates. All persons employed by the Concessionaire shall be engaged by him as his own employees/workers in all respects and all rights and liabilities under the Indian Factories Act, the Employees Compensation Act, Employees Provident Fund & Miscellaneous Provisions Act (EPF & MP Act), Industrial Disputes Act, Employees State Insurance Act, Contract Labour (R&A) Act and under all other applicable enactments in India in respect of all such personnel shall exclusively be that of the Concessionaire.
