LEGAL RECOURSE. In the event the USER violates any of the terms or conditions of this Agreement, COUNTY shall have, in addition to any other legal recourse, the right to terminate this Agreement and obtain possession of the entire Authorized Area, and to remove and exclude the USER there from, all without service of notice or resort and without any legal liability on its part.
LEGAL RECOURSE. Employee further agrees that these covenants are made to protect the legitimate business interests of the Employer. Employee understands as a part of these covenants that the Employer intends to exercise whatever legal recourse against him for any breach of this Agreement and in particular, for any breach of these covenants.
LEGAL RECOURSE. Any civil suit or proceeding relating to any aspect of this lease and contract shall be filed in the appropriate court in the state court system of Mississippi, and not elsewhere. Resident shall not file any civil proceeding against Owner in federal court and agrees not to remove any case filed by Owner from the state courts to federal court. In the event of litigation, the prevailing party shall recover reasonable attorney’s fees and all associated litigation expenses, in an amount to be set by the judge presiding over the case. All amounts recovered in any civil action shall bear interest at the rate of eight percent (8%) per annum compounded annually. LEGAL RECOURSE. If all efforts at agreement within a reasonable time are unsuccessful, the parties may have recourse to their available legal remedies.
LEGAL RECOURSE. Any dispute(s) or claim(s) with respect to this Agreement or the performance of any obligations there under, may be brought in a court of competent jurisdiction in the State of New York. The Client and WAW, each, irrevocably submits to the jurisdiction of any court of the State of New York located in the City and County of New York and to the jurisdiction of the United States District Court for the Southern District of New York for the purpose of any suit, action or other proceeding arising out of or relating to this Agreement, the options, the securities mentioned herein or WAW’s engagement hereunder. Each of the parties, recognizing the costs and uncertainty of trial by jury hereby waives any right it may have to a trial by jury in respect of any claim brought by or on behalf of either party based upon, arising out of or in connection with this Agreement, the options, the securities mentioned herein or WAW’s engagement hereunder.
LEGAL RECOURSE. Notwithstanding the other provisions of this XXXX, in the event of a breach or threatened breach of the agreements in this provision by the receiving party, the disclosing party shall be entitled to seek a court ruling to protect its interests.
LEGAL RECOURSE. With the exception of arbitration, where the ombudsman service issues a decision binding the two parties, legal proceedings are always possible. Any disputes concerning the interpretation or application of the agreement fall under the sole jurisdiction of the Belgian common courts.
LEGAL RECOURSE. The Brussels lower courts have sole jurisdiction for any claims or disputes relating to the interpretation or performance of the Agreement.
