Customer Content. As part of the Services provided under this Agreement, Customer Data will be stored and processed in the data center region specified in the applicable Ordering Document. Axway shall not access Customer Content except in response to support or technical issues where Customer provides Axway with prior Customer’s written authorization required to access such Customer Content. Axway is not responsible for unauthorized access, alteration, theft or destruction of Customer Content arising from Customer’s own or its authorized users’ actions or omissions in contravention of the Documentation. Customer’s ability to recover any lost data resulting from Axway’s misconduct is limited to restoration by Axway from the most recent back-up.

Customer Content. (1) Customer is solely responsible for the content and preservation of all data (A) entered into the Cloud Services by or on behalf of Customer; (B) generated through Customer’s use of the Product; or (C) collected by the Product while interacting with other Customer equipment or systems (collectively, “Customer Content”). Customer has and shall maintain the legal bases and right to share Customer Content with S&SC and its service providers. Customer shall secure and maintain all rights in Customer Content necessary for the provision of the Cloud Services without violating the rights of any non- party or otherwise obligating S&SC or its service providers. S&SC does not assume any obligations with respect to the Customer Content other than as expressly set forth in this agreement or as required by applicable law.
Customer Content. Customer is responsible for the Customer Content and entering it into the Products. Customer has sole responsibility for the accuracy, quality, integrity, legality, reliability, and appropriateness of Customer Content, and for obtaining all rights related to Customer Content required in connection with the performance, receipt or use of the Products or Support Services. Customer will collect and maintain all personal data contained in the Customer Content in compliance with applicable data privacy and protection laws.
Customer Content. You own and reserve all right, title and interest in your Customer Content. By sending Customer Content to a Hosted Service, you grant us a worldwide, royalty free, non-exclusive license to access and use the Customer Content for purposes of providing you the Hosted Service.
Customer Content. Customer hereby grants Vintory a non-exclusive, non-transferable, limited license, revocable at will by Customer, to copy and use all content, material, and information provided by Customer, including but not limited to Customer logos, trademarks, service marks, and material subject to copyright (“Customer Content”) solely in connection with the Deliverables to be performed by Vintory under this Agreement. Customer represents and warrants that the Customer Content is owned by Customer, or that the Customer has permission from the rightful owner to use the material or content and that such does not infringe upon any intellectual property right or other third-party rights.

Customer Content. Customer is solely responsible for collecting, inputting and updating all Customer Content stored on the Software, and for ensuring that the Customer Content does not (i) include anything that actually or potentially infringes or misappropriates the copyright, trade secret, trademark or other intellectual property right of any third party, or (ii) contain anything that is obscene, defamatory, harassing, offensive or malicious. Customer shall: (i) notify Whatfix immediately of any unauthorized use of any password or user id or any other known or suspected breach of security, (ii) report to Whatfix immediately and use reasonable efforts to stop any unauthorized use of the Service that is known or suspected by Customer or any End User and (iii) not provide false identity information to gain access to or use the Service. Customer owns and shall retain all right title and interest in and to the Customer Content which is (i) provided by Customer to Whatfix for the purpose of the provision of the Service and/or the Professional Services; (ii) created by Customer using the Service; and/or (iii) to the extent applicable, created by Whatfix specifically for Customer under the provision of Professional Services, and which incorporates or is based on Customer’s copyrighted work and/or Customer’s Confidential Information. Customer Content specifically excludes Content provided by Whatfix which does not use Customer Content, the Software’ “look and feel”, and Whatfix’s Confidential Information and Intellectual Property.
Customer Content. (a) Customer is solely responsible for the development, content, operation, maintenance, and use of Customer Content including but not limited to responsibility for: (i) any claims relating to Customer Content, including claimed violations of applicable law; and (ii) properly handling and processing notices that are sent to Customer (or any Customer Affiliate) regarding Customer Content, such as by any person claiming that Customer Content violate such person’s rights, including notices pursuant to the Digital Millennium Copyright Act.
Customer Content. The Customer is solely responsible for the content of any postings, data or transmissions using the Service, or any other use of the Service by the Customer or by any other person the Customer permits to access the Services (a “User”). The Customer represents and warrants that neither it nor any User will use the Service for unlawful purposes (including, without limitation, infringement of copyright or trademark, misappropriation of trade secrets, wire fraud, invasion of privacy, illegal pornography, obscenity, defamation, or transportation or sale of controlled substances and firearms), or to interfere with, or disrupt, other network users, network services, or network equipment. Disruptions include, without limitation, distribution of unsolicited advertising or chain letters, repeated harassment of other network users, wrongly impersonating another user, falsifying one’s network identity for improper or illegal purposes, sending unsolicited mass e-mailings, propagation of computer viruses, using the network to make unauthorized entry to any other machine accessible location, via the network, and distributing of tools designed for compromising security (i.e. including, but not limited to, password guessing programs, cracking tools or network probing tools). Unwired may suspend or terminate the Service immediately, without prior notice to the Customer, if Unwired believes, in good faith, that the Customer or a User is utilizing the Service for any such illegal or disruptive purpose.
