Conditions Under Which. This Agreement May Be Terminated • Failure to pay tuition for more than 30 days, or pay the balance of past due tuition, may result in termination of this agreement. • In the event that a child requires additional care or service that DLC cannot provide, the child may be dropped immediately from enrollment. • In the event that a parent teacher conference is requested by DLC staff and the parents choose to not meet or comply, the child may be dropped from enrollment. • In the event that a child presents a danger to them self, another child, or the staff, the child will be dropped immediately, without notice. • In the event that DLC is unable to continue bussing a school-age child to/from their school, the family will be notified and DLC will continue to provide bussing for up to 14 days. • In the event that a parent has a fundamental philosophical difference with DLC regarding our curriculum, approach to child development and/or education. If these differences prevent parents and teachers from working together enrollment may be terminated. • In the event that DLC is no longer able to provide childcare for any of the above-mentioned reasons, any unused and paid tuition will be prorated and reimbursed.

Conditions Under Which a company leaves the scope of application Any company that ceases to meet the conditions defined in Article 1 above will be excluded from the scope of this agreement, in accordance with the legal provisions in force. An endorsement to this agreement, amending appendix 1, will formalise the removal of this company from its scope.
Conditions Under Which. Paid Leave Credits May Be Used.
Conditions Under Which. Paid Leave Time May Be Donated to an Employee Any full-time, permanent employee may donate accumulated vacation, compensatory time or holiday time to an eligible employee in the same department. Sick leave cannot be donated. Donations must be made in increments of one regular work day (or more) from the donating employee. The donation of paid leave time is irreversible. Should the employee receiving the donated hours not use all donated leave for the catastrophic illness/injury, any balance will remain with that employee or will be converted to cash upon the employee’s separation from County employment. Donated paid leave time shall be converted to its cash value and then credited to the recipient in hours at the recipient’s base hourly rate as holiday credit. State and Federal Income Tax, and Social Security (F.I.C.A.) if applicable, on the value of the leave donated, is deducted from the contributing employee’s pay at the time of donation on the next bi-weekly pay check. Employees donating paid leave time shall do so in writing on a form developed by the County. All donation transactions shall be credited effective the pay period following submittal of the form requesting the paid time donation.
Conditions Under Which. Paid Leave Credits May Be Used The employee requesting to use “catastrophic leave” shall submit a written request to their appointing authority for review. The request must include a written statement from a licensed physician verifying the illness or injury. If the appointing authority approves the request it shall be forwarded to the Auditor- Controller for implementation, along with the form from the employee donating time to the affected employee. The affected employee must have exhausted any accumulated paid leave time for which they are eligible (sick, vacation, compensatory, holiday) prior to utilizing catastrophic leave. Any paid leave time accrued by the affected employee while using donated time must be used during the next pay period. Only full-time permanent employees are eligible to receive donated paid leave time. The use of donated paid leave time shall not exceed three months for any one catastrophic illness/injury. In no event shall a leave for the recipient employee be granted for longer than one year from the time the employee is unable to work in their regular job.
