Pending final determination of whether the Settlement should be approved, Class Representatives and all Class Members shall not institute, commence, or prosecute any action which asserts Released Plaintiffs’ Claims against the Released Defendant Parties.
The obligations incurred pursuant to this Stipulation are (a) subject to approval by the Court and the Judgment, or Alternate Judgment, if applicable, reflecting such approval becoming Final; and (b) in full and final disposition of the Action with respect to the Released Parties and any and all Released Plaintiffs’ Claims and Released Defendants’ Claims.
Unless you properly exclude yourself, you will remain in the Class and you will give up any rights to sue Defendants and the other Released Defendant Parties for any and all Released Plaintiffs’ Claims.
This is the only option that, assuming your claim is timely brought, might allow you to ever bring or be part of any other lawsuit against Defendants and/or the other Released Defendant Parties concerning the Released Plaintiffs’ Claims.
