In such event, any Final Judgment or other order entered by the Court in accordance with the terms of this Agreement shall be vacated by the Court, and the Parties shall be returned to the status quo ante with respect to the Action as if this Agreement had never been entered into.
Class Counsel and Defendant’s Counsel agree to cooperate with one another in seeking Court approval of the Agreement, entry of the Preliminary Approval Order, and the Final Judgment, and to promptly agree upon and execute all such other documentation as may be reasonably required to obtain final approval of the Agreement.
