Subject to Sections 4.6 and 14, upon the Effective Date of Settlement, Defendants absolutely and unconditionally release and forever discharge Plaintiffs’ Releasees and Class Counsel from any and all of Defendants’ Released Claims.

This Settlement Agreement shall be binding upon and inure to the benefit of the successors and assigns of the Parties, including the Plaintiffs’ Releasees, Defendants, and any and all Defendants’ Releasees, and any corporation, partnership, or other entity into or with which any Party hereto may merge, consolidate or reorganize.
