Released Defendants. Claims” means all claims and causes of action of every nature and description, whether known claims or Unknown Claims, whether arising under federal, state, common or foreign law, that arise out of or relate in any way to the institution, prosecution, or settlement of the claims asserted in the Action against the Defendants. Released Defendants’ Claims do not include any claims relating to the enforcement of the Settlement or any claims against any person or entity who or which submits a request for exclusion from the Settlement Class that is accepted by the Court.
Released Defendants. Claims” means any and all claims and causes of action of every nature and description whatsoever, including both known claims and Unknown Claims, against Lead Plaintiffs, Lead Plaintiffs’ Counsel or any Class Member that arise out of or relate in any way to the institution, prosecution, or settlement of the claims against Defendants in the Litigation, except for claims relating to the enforcement of the Settlement.

For the avoidance of doubt, the Parties acknowledge and agree that the Released Defendants Persons and the Released Plaintiffs Persons are intended beneficiaries of the Releases in this Stipulation and are entitled to enforce the Releases contemplated by the Settlement.
This Stipulation shall be binding upon and inure to the benefit of the successors and assigns of the Parties, including Released Plaintiffs Persons and Released Defendants Persons, and any corporation, partnership, or other entity into or with which any Party hereto may merge, consolidate, or reorganize.
Defendants and the other Released Defendants Persons shall not have any involvement in or any responsibility, authority, or liability whatsoever for the selection of the Settlement Administrator.
Pending final determination of whether the Settlement should be approved, Plaintiffs and all Class Members are barred and enjoined from commencing, prosecuting, instigating, or in any way participating in the commencement or prosecution of any Plaintiffs’ Released Claim against any Released Defendants Person.
In the event that the Settlement is terminated pursuant to the terms of this Stipulation, all Notice and Administration Costs paid or incurred shall not be returned or repaid to Defendants, any of the other Released Defendants Persons, or any other person or entity who or which paid any portion of the Settlement Amount.
