Class Representative. The Court appoints Plaintiff to act as the representative of the Settlement Class pursuant to Rule 23 of the Federal Rules of Civil Procedure.
Class Representative. “Class Representative” is defined in the first paragraph of this Agreement.
Class Representative. Class Members, Defendant, and the Plan shall hold the Released Settling Parties, Defense Counsel, Class Counsel, and the Settlement Administrator harmless from the costs (including, for example, attorneys’ fees and disbursements) of any proceedings (including, for example, investigation and suit), related to any tax liability.
Class Representative. Plaintiff Xxxx Xxxxxxxxx is designated as Class Representative for 7 the Settlement Class.
Class Representative. “Class Representative” means plaintiffs Xxxxx Xxxxxxxx and/or Time Traders, Inc.
Class Representative. Upon the Effective Date, and in exchange for the relief described in this Agreement, the Class Representative hereby releases and forever discharges the Released Parties from any and all claims, actions, and causes of action, including claims for attorneys’ fees, asserted or which could have been asserted as of the Effective Date, or which now exist or might arise out of any duties or obligations owed by Defendants to Class Representative, as of the Effective Date. This release includes all claims, whether known or unknown, asserted or unasserted, which Class Representative may currently have against the Released Parties, or that may arise in the future up to and including the Effective Date.
Class Representative. Subject to Court approval, the named Plaintiff shall be appointed by the Court as class representative of the Settlement Class (“Class Representative”).

Class Representative. The Court’s Class Certification Order appointed Plaintiff, Xxxxx Xxxx, to act as the representative of the Class pursuant to Rule 23 of the Federal Rules of Civil Procedure. As this Court has already appointed Xx. Xxxx as class representative of the Class as defined in Plaintiff’s Motion for Preliminary Approval, this determination requires no further analysis, and appointment of Xx. Xxxx as representative of the Settlement Class is hereby likewise approved.
