Warranty Limitations and Exclusions. Xxxxxx+Gyr’s warranty obligations with respect to the Equipment and Software comprising the System do not apply to the extent a failure or warranty non-conformity is caused by: Customer’s or a third party’s infrastructure or data; Customer’s or a third party’s misuse of the equipment or software comprising the System; installation by Customer or a third party not in compliance with training or manuals provided by Xxxxxx+Gyr; operation, maintenance or use by Customer or third parties not in compliance with applicable training, manuals or specifications provided by Xxxxxx+Gyr; Customer’s or a third party’s neglect, modification, accident, vandalism or other intentional damage; exposure to adverse conditions exceeding performance levels required by applicable specifications; or any other limitation or exclusion described herein; data provided by Customer.

Color variations may also be affected by age, character of cabinets, and exposure to UV light, sunlight, smoke, household cleaners, and other environmental conditions. As such, new and/or replacement cabinets may not match display samples and/or existing cabinets. Any such variations and changes to Echelon Cabinetry products, whether present during production or which develop over time, are not considered quality defects and are not covered by this warranty. • Painted finishes have unique characteristics that differ from standard wood finishes. Wood of all species is subject to the humidity and temperature of its environment and may expand or contract due to changes in weather, temperature, or climate. Due to these normal shifts in the environment, painted wood cabinetry may develop hairline cracks, peeling, or separation or seam lines. On select hardwoods and veneers, joints, seams, and some natural characteristics of the wood (including, but not limited to, grain patterns, knots, and mineral streaks) will remain visible through painted finishes. As painted cabinet products age, the finish may mellow or discolor slightly. The degree of change to the original finish color is affected by the products’ exposure to natural and artificial light. These normal variations are not considered quality defects and are not covered by this warranty.

Warranty Limitations and Exclusions. The Warranty is subject to the following limitations and exclusions:  The Warranty applies only if the X-Link is used while worn by a human being diving to a depth not  The 7-pin Xxxxxxx Cable Connector is a fragile, specialized water-resistant cable connector that allows divers to plug their rebreather cable into the X-Link. The Xxxxxxx Connector requires careful maintenance prior to diving and gear storage (details in X-Link User Manual). Damage to the Xxxxxxx Connector is NOT covered by the X-Link Warranty.  The X-Link comes with a protective end cap for the Xxxxxxx Connector. This cap must be placed on the Xxxxxxx Connector prior to any dive during which the rebreather cable is not connected, following the procedure detailed in the User Manual. Damage to the Xxxxxxx Connector due to incorrect use of the protective end cap, or failure to use the end cap, is NOT covered by the X-Link Warranty.  The X-Link is recharged using the multifunction attachment and AC adapter provided with the X1 Dive Computer. The multifunction attachment and AC adapter are not intended for use underwater, and any submersion of those items in water will void the Warranty in respect of those items.  The X-Link must not be recharged in direct sunlight or while exposed to temperatures in excess of 45°C (113°F). Failure to comply with this requirement will void the Warranty.  The X-Link must be used in accordance with the X-Link User Manual. The Warranty does not apply to defects or damage caused by: (i) misuse, neglect or improper or rough handling (including punctures, bending, compressing or dropping of the X-Link); (ii) any use of the X-Link not in accordance with the X-Link User Manual; (iii) use of the X-Link with or connection of the X-Link to any product, accessory, software and/or service not manufactured, supplied or approved by Liquivision; (iv) normal wear and tear; or (v) accidents, fire, power changes, other hazards, acts of God and other causes beyond the reasonable control of Liquivision.  The Warranty does not apply to 3rd Party Software, other software, settings, content or data that is generated by the X-Link and stored on the X1 Dive Computer at the time of purchase or afterwards, whether by Liquivision, you or any third party.  The Warranty will be void if: (i) the X-Link has been opened, modified or repaired by any person other than Liquivision; (ii) the X-Link’s serial number has been removed, erased, defaced or altered in any way or is illegible, as d...
