Transfer Outside of Bargaining Unit. An employee who is transferred to a position outside the bargaining unit for a period of greater than four (4) weeks and less than fifteen (15) months or such longer period as the parties may agree upon shall retain but not accumulate seniority held at the time of transfer. In the event the employee is returned to a position in the bargaining unit within this time period he shall be credited with the seniority held at the time of transfer and shall resume accumulation from the date of his return to the bargaining unit. Union dues will not be deducted for the period of time an employee is outside the bargaining unit under this Article.

Transfer Outside of Bargaining Unit. (a) An employee, who is transferred to a position with the Employer outside of the bargaining unit for a period of six (6) months or less, or for an academic year, shall continue to accumulate seniority for the period of the transfer.

The Union shall be informed of the return to the bargaining unit by the Employer of an Employee from a position outside the unit.
Transfer Outside of Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without his consent. An employee transferred out of the unit shall retain his seniority for up to sixty (60) shifts. If the employee returns to the bargaining unit within the sixty (60) shifts, he will move back into the position he held prior to leaving the unit. Other employees affected will also bump back into their original positions.

If such a transfer does take place, the employee shall retain the employee’s seniority acquired to the date of the transfer, for a period of up to two (2) years, but will not accumulate any further seniority. If such an employee later returns to the bargaining unit, the employee shall be placed in a job consistent with that employee’s seniority, and the employee’s return shall not result in the lay-off or bumping of an employee holding greater seniority.

In the event the employee is returned to a position in the bargaining unit, she or he shall be credited with seniority held at the time of transfer and resume accumulation from the date of her or his return to the bargaining unit. In the event that an employee is transferred to a position outside of the bargaining unit for a period in excess of one (1) year, she or he will lose all seniority held at the time of transfer. In the event the employee is returned to a position in the bargaining unit, the employee’s seniority will accrue from the date of her or his return to the bargaining unit. It is understood and agreed that an employee may decline such offer to transfer and that the period of time referred to above may be extended by agreement of the parties.

If an Employee agrees to be transferred to a position outside this bargaining unit, she shall retain her seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority. An Employee shall have the right to return to her position in the bargaining unit with no loss of rank, seniority or benefits within six (6) months of leaving the bargaining unit or such other period as may be mutually agreed between the parties and confirmed in writing. It is understood that any Employee hired or promoted to her vacated position in this bargaining unit may be laid off or returned to her former classification even though her probationary period in this bargaining unit has passed.
