Observation Procedure Clause Samples
The Observation Procedure clause defines the process by which parties monitor, verify, or assess certain events, conditions, or performance under an agreement. Typically, this clause outlines the steps for conducting observations, such as providing notice, specifying the timing and manner of observation, and detailing any required documentation or reporting. Its core practical function is to ensure transparency and accuracy in verifying compliance or the occurrence of specific events, thereby reducing disputes and misunderstandings between parties.
Observation Procedure. 1. All teachers and staff members who will be evaluated herein will receive training in all aspects of OTES, the state adopted evaluation framework, and the standards for the teaching profession prior to beginning their work. (See appendix for other suggestions as to training.)
a. All “teachers” shall be evaluated based on two (2) observations each school year.
Observation Procedure. A. Every teacher shall be observed by the administration at least once each year. The response, orally or written, will be determined by the administration. See Appendix E for Classroom Observation Form.
B. Two items will be chosen for observation from CSTP 1, CSTP 2 and CSTP 3. An additional item will be selected from CSTP 5. The observed teacher and the administrator will select the items jointly at the pre-observation conference.
Observation Procedure. 1. By September 30 of each school year, teachers will be notified of the primary evaluator assigned to complete their evaluations, and the documents to be used will be shared. Any teacher hired after the beginning of the school year shall be notified within 15 work days of his/her first work day of his/her role in the evaluation process. All evaluators will be credentialed by the Ohio Department of Education and an administrator employed by the Board.
2. Administrators will conduct a preconference not more than five (5) work days prior to the observation utilizing the form mutually agreed upon by the HEA and the Board.
3. Administrators will conduct a postconference within five (5) work days of the observation utilizing the form mutually agreed upon by the HEA and the Board.
4. Administrators will provide the written report including commendations and recommendations within five (5) work days of the observation postconference utilizing the form mutually agreed upon by the HEA and the Board.
5. At least ten (10) work days must pass between the conclusion of a previous observation cycle and the start of a subsequent observation cycle.
6. Administrators will provide the completed written summative evaluation report including commendations and recommendations not later than May 10 utilizing the form mutually agreed upon by the HEA and the Board.
7. Copies of all completed Evaluation Forms shall be delivered only to the teacher, evaluator, and Superintendent of schools.

b. Teachers on a limited contract who are under consideration for nonrenewal shall receive at least three (3) observations.
c. The first observation must be completed by December 15.
d. The second/third observation must be completed by May 1.
e. There will be at least fifteen (15) school days between observations.
f. All formal observations shall be preceded by a conference between the evaluator and the employee.
g. Pre-conference form will be provided to the teacher. Teacher will be notified three (3) days prior to pre-conference of date and time of observation. (See Appendix D for form.)
h. A post-observation conference shall be held within five (5) working days after the observation where the evaluator will give the teacher the completed observation form. The post observation conference will include reflection from both parties.
i. All observations will be announced.
j. Time limits may be adjusted due to unforeseen circumstances. At the agreement/discretion of the Superintendent or Administration and the FEA, these limits may be altered.
2. Periodic Walkthroughs
a. Walkthroughs shall not unreasonably disrupt and/or interrupt the learning environment.
b. Teachers will have no more than four (4) walkthroughs in each evaluation cycle.
c. Walkthroughs will be no less than five (5) minutes and no more than fifteen (15) minutes.
d. Walkthrough form attached – provided to the “teacher” by the evaluator within five (5) working days.
e. A final debriefing shall be held with the “teacher” by the evaluator within five (5) working days of the walkthrough if requested by the teacher or administrator. Any corrective action will be addressed in this debriefing.
f. Time limits may be adjusted due to unforeseen circumstances. At the agreement/discretion of the Superintendent or Administration and the FEA these limits may be altered.
Observation Procedure. 1) The teaching staff member being evaluated should be a partner in the evaluation process. In order to ▇▇▇▇▇▇ the development of mutual trust, confidence and respect that is essential for the purposes of evaluation to be realized, the evaluator and the teaching staff member shall meet for a pre-observation conference prior to the outset of the first observation. At this conference, the evaluator will provide and discuss with the teaching staff member a written statement of (1) the observation procedure, (2) the evaluative criteria, and (3) the data collection methods to be followed in evaluating his/her performance.
2) All non-tenured teaching staff members will be observed a minimum of three (3) times in each school year, but not less than once during each semester. All tenured teaching staff members will be observed at least once a year. For non-tenured teachers, the first observation shall occur no later than February 1 and a second observation no later than April 15; provided further, that in the first year of a teacher’s employment all three observations shall be completed prior to April 30. For tenured teachers, the observation shall occur no later than April 15. A tenured teaching staff member shall be observed a second time if he/she files a written request for the same with the Building Principal or administrative superior on or before April 30. The second evaluation, if requested, shall be completed on or before May 31st
3) All observations will be at least the length of a full teaching period or a minimum of thirty (30) minutes and shall occur on separate days. All observations of teaching staff performance shall be conducted openly and with full knowledge of the staff member. Electronic devices may be used to facilitate data collection with the consent of the teaching staff member.
4) Before any observation report is finalized, submitted to the Central Administration, or placed in the personnel file, such report should be discussed at a post-observation conference with the teaching staff member and the observer. At least one (1) day prior to the post-observation conference the teaching staff member shall be given a copy of the written report of his/her performance. The teaching staff member shall have the right to submit a written response to any material included in the report within fifteen (15) days of the post conference. Observation Procedure. 8.5.1 Within six (6) days of any observation, or series of observations not to exceed five (5) days to be used for evaluation purposes, the Principal or other observer shall document the results thereof using Appendix 8 and shall provide a copy to the employee. Upon completion of each required observation report, at the request of either party, a conference shall be held between the observing administrator and the employee to discuss the report. At the request of the employer or employee, those meetings may take place during a preparation and planning period. The employee shall be entitled to append comments or explanations to the reports within a reasonable amount of time. If a Principal or other observer requests that a pre-observation form be submitted by the employee, such form may be completed in writing before a scheduled observation and/or evaluation conference or the employee may come to the conference prepared to discuss the items verbally.
Observation Procedure. 1. A teacher shall be given a copy of any formal observation report prepared by his/her evaluator(s) within (10) school days of the observation. The observation report should identify the strengths and/or weaknesses, if any, of the teacher's performance. If any weaknesses are noted, remedies and assistance for their correction should be included. A conference shall be scheduled to discuss it. If the teacher wishes, she/he may request additional conference time prior to the observation forms being placed in the teacher's file. No such observation report shall be submitted to Central Office, placed in the teacher's file or otherwise acted upon without an opportunity for a conference with the teacher. The teacher shall sign the observation form as an acknowledgment of having seen the report and comments therein, with the express understanding that such signature in no way indicates agreement with the contents thereof. No teacher shall be required to sign a blank or incomplete observation form.
2. The conference shall be held within five (5) school days after receipt by the teacher of the written observation report. At such conference, the teacher shall be prepared to discuss with the supervisor and/or administrator her/his strengths and/or weaknesses. Conferences should be held within the school day. The right to representation at such a conference shall be in accordance with the law. Teachers shall have the right to submit a written answer to such material which shall be reviewed by the superintendent and shall be attached to the file copy.
3. In no case shall another observation for purposes of formal evaluation be conducted sooner than twenty (20) school days following the conference concerning the previous formal classroom observation. Observations shall be completed by the first full week in June.
Observation Procedure.
A. Required Observations
1. New employees shall be observed at least one time within the first ninety (90) Calendar days from the commencement of their responsibilities. They shall be observed at least one more time before May 1 of that school year.
2. Continuing employees on the Long Form or Comprehensive Evaluation cycle shall have at least two required classroom observations during the school year. The total observation time for these observations shall be not less than sixty (60) minutes. At least one of these observations shall be a minimum of thirty (30) continuous minutes. The first of these required observations shall occur on or before January 30 of each year. The second required observation shall occur prior to May 15.
B. Additional Observations
1. In addition to the above required observation, additional observations may be made by the evaluator.
2. All additional observations shall be reported to the employee and documented on the Observation Report form within three (3) working days of the additional observation.
3. Any additional observations shall be subject to the provisions of this Article if they are to be used in the evaluation process. If the additional observation is concerned with actual course instruction, it should be of at least fifteen (15) minutes in duration. Other additional observations not involving actual course instruction shall have no time limitations.
4. There must be a post-conference within three (3) working days for any additional observation to be used in the Evaluation Report.
A. Pre-observation Conferences
1. A pre-observation conference shall be held between the evaluator and the employee prior to each required observation to apprise the evaluator of the employee’s objectives, methods, and materials planned for the situation to be evaluated.
2. If a required observation is scheduled and the evaluator is unable to attend, another pre-observation conference shall be held at the request of either the evaluator or the employee.
B. Post-Observation Conferences
1. Within three (3) working days following any observation, the evaluator will provide the employee with a copy of any observation notes made.
2. There shall be a post-conference within three (3) working days after presentation of any Observation Report Form (Exhibit D) to provide feedback on the observed performance and to enable the employee to respond to the observation notes and any conclusions drawn from it.
Observation Procedure. The evaluator may conduct a reasonable number of observations. After each formal observation, the evaluator will discuss with the unit member the evaluator’s observation and evaluations of the performance of the unit member. The unit member shall have the right to initiate a written response to the observation which will be part of the personnel file record.
Observation Procedure. At a pre-observation conference, the observer will provide and discuss with the teaching staff member the observation procedure, the observation criteria, and the data collection methods to be followed.
