MAINTENANCE AND GUARANTEE. 6.1 The company agrees to maintain and service the transmitter for the duration of this agreement, if necessary, at its expense. The company undertakes no responsibility whatsoever for the maintenance and/or repair of any alarm system or any component thereof not installed or not covered by a guarantee from the company and the customer undertakes that any such alarm system shall at all times during the existence of this agreement be kept in proper working order and condition by the customer at its sole cost and expense. Upon request by the customer, the company will provide a quotation and proceed with the repairs to such an alarm system on the acceptance by the customer. The customer shall not withhold any payments payable to the company in respect of this agreement due to the non- performance of the alarm system. It is specifically agreed that it is the responsibility of the customer to test the alarm system at least once a month and to ensure that all detection devices are connected to the alarm system provides adequate protection as required by the customer and/or his insurer from time to time.

MAINTENANCE AND GUARANTEE. All equipment must have a comprehensive operational guarantee of at least twelve months. A service contract for a period of twelve months, coinciding with the period of guarantee, is required as part of this tender / contract.
MAINTENANCE AND GUARANTEE. (1) The Licensor guarantees maintenance of the contractually agreed quality of the Software during the term of the Agreement and that there are no third-party rights in opposition to the contractual use of the Software. The Licensor will correct any material and legal defects in the leased goods within a reasonable time. If the defect has no or only a minor adverse effect on the functionality of the Software, Xxxx is entitled to remedy the defect by delivering a new version or an update as part of Xxxx’x version and update planning program. The same applies to defects of third-party programs if these defects do not impair functionality or impair it only to a minor extent.
MAINTENANCE AND GUARANTEE. 6.1 The COMPANY agrees to maintain and service the TRANSMITTER for the duration of this Agreement, where renewed if necessary, and at its expense. The COMPANY undertakes no responsibility whatsoever for the maintenance and/or repair of any ALARM SYSTEM or any other component that makes up the ALARM SYSTEM or TRANSMITTER if not installed by the COMPANY. Upon request by the CUSTOMER, the COMPANY will provide a quotation and proceed with repairs to such an ALARM SYSTEM on the acceptance of the quotation by the CUSTOMER. The CUSTOMER shall not withhold any payment payable to the COMPANY in respect of this Agreement due to the non-performance of the ALARM SYSTEM. It is specifically agreed that it is the responsibility of the CUSTOMER to test the ALARM SYSTEM at least once a month and to ensure that all detection devices connected to the ALARM SYSTEM provide adequate protection as required by the CUSTOMER and/or his insurer from time to time. The COMPANY shall not be liable for any claim of whatsoever nature and howsoever arising, if based upon a faulty transmitter or alarm not installed and/or maintained by the COMPANY.
MAINTENANCE AND GUARANTEE. Concessionaire hereby guarantees that the entire work constructed by him under contract will meet fully all requirements thereof as to quality of workmanship and of materials furnished by him/her. Concessionaire hereby agrees to make, at his/her own expense, any repairs or replacement made necessary by defects in material or workmanship supplied by him/her that becomes evident within one (1) year after completion, and to restore to full compliance with the requirements of the contract, any part of the work which, during said one year period, is found to be deficient with respect to any provision of the contract. Concessionaire shall make all repairs and replacement promptly upon receipt of written orders from Casitas to do so. If the Concessionaire fails to make the repairs and replacements promptly, Casitas may do the work and the Concessionaire and his/her Surety shall be liable to Casitas for the cost thereof.
MAINTENANCE AND GUARANTEE. The Contractor, at the Contractor’s sole cost and expense, shall promptly repair, replace, restore or rebuild, as the DOT may determine, any finished Work in which defects of materials or workmanship may appear or to which damage may occur because of such defects, during the six (6) month period subsequent to the date of substantial completion, except where other periods of maintenance and guarantee are provided for. For installation of new systems and equipment, this period shall be one (1) year minimum. The warranty period applicable to defects in materials and workmanship shall commence on the day DOT declares substantial completion of the vessel. If any remedial Work is performed by the Contractor or by any other Party under the provisions of this Section, the warranty period shall be extended by the amount of time that the vessel is out of service by reason of such remedial Work. The warranty period applicable to defects in any remedial Work performed under the provisions of this section shall commence on the day on which such remedial Work has been completed and accepted by DOT and shall continue for a six
