Contractor and City further agree that City would be damaged by Contractor's failure to meet the Service Levels specified in Exhibit A – Appendix A6, entitled Operation and Maintenance, and that making a precise determination of the amount of damages resulting from Contractor's breach would be impracticable and/or extremely difficult.
Tenant shall ensure that no pollution or Hazardous Materials of any type is discharged from the Premises into the stormwater system at the Airport and shall comply with Lessor’s NPDEP in all respects as it relates to the Premises and in accordance with the Stormwater Control Plan and Stormwater Control Operation and Maintenance Plan for the Premises, and any amendments thereto, and in accordance with all applicable laws and regulations and other Lessor requirements.
The quantity of water purchased by each Party from the Xxxxx Mountain Lake Water Facility will determine the proportionate share of each Party toward payment of the total cost of the Operation and Maintenance Expenses.
This Agreement supersedes and replaces the Parties’ Interlocal Agreement for the Operation and Maintenance of Geographic Information Services, dated effective February 12, 2019.
