The Parties must comply with the arrangements for reporting, investigating, implementing and sharing the Lessons Learned from Serious Incidents, Patient Safety Incidents and non-Service User safety incidents that are agreed between the Provider and the Authority and set out in Appendix A (Incidents Requiring Reporting Procedure). Subject to the Law, the Authority shall have complete discretion to use the information provided by the Provider under this clause 15 and Appendix A (Incidents Requiring Reporting Procedure).

If the Provider gives a notification to the CQC or any other regulatory body regarding serious untoward incidents and patient safety incidents which directly or indirectly concerns any service user, the Provider shall send the Council a copy of any notification within one month of the original submission of the notification. The Parties must comply with the arrangements for reporting, investigating, implementing and sharing the Lessons Learned from serious incidents, patient safety incidents and non-service user safety. Subject to the Law, the Council shall have complete discretion to use the information provided by the Provider under this Clause B.5.

SERIOUS INCIDENTS Serious Incidents include “acts or omissions in care that result in; unexpected or avoidable death, unexpected or avoidable injury resulting in serious harm - including those where the injury required treatment to prevent death or serious harm, abuse, Never Events, incidents that prevent (or threaten to prevent) an organisation’s ability to continue to deliver an acceptable quality of healthcare services and incidents that cause widespread public concern resulting in a loss of confidence in healthcare services.” It is the responsibility of the Provider to identify, report and investigate such incidents. There are no definitive lists of Serious Incidents, and in the event of a potential Serious Incident being identified, The Provider shall adhere to the NHS England Serious Incident Framework ( March 2015), which sets out clearly the definition and thresholds for a Serious Incident, the principles of management of such an incident and the detailed management plan and timescales. In additional to any Safeguarding requirements in the Contract and the Service Specification, the Provider shall carry out the following: The Provider shall report any Serious Incident directly to the Commissioner, via the agreed electronic communication pathway – reports to be sent to: xxxx.xxx@xxx.xxx This must be done within 2 working days of the event occurring unless immediate action is required. This shall be in addition to the requirement for any NHS Provider to report using the NHS XXXXX system.
