Failure to Return from Leave Sample Clauses

Failure to Return from Leave. Any employee who has been granted any type of unpaid leave of absence and who, for any reason, fails to return to work at the expiration of said leave of absence shall be considered as having resigned her or his position with the County, and her or his position shall thereupon be declared vacated, except and unless she or he has furnished evidence that she or he was unable to return to work for reasons protected by applicable Federal or State laws.

Failure to Return from Leave. 16 Except where otherwise provided by law, any employee who has been 17 granted a leave of absence and fails to return to work within five (5) days after the 18 expiration of said leave, shall be considered to have voluntarily resigned his or her 19 position. However, if an employee provides evidence that he or she was unable to contact 20 the County to request a leave extension on the date of, or subsequent to, the last day of 21 the leave, the County shall rescind the employee's resignation. Nothing in this section is 22 intended to prohibit application of Article 17, Disciplinary Action, in cases of absence 23 without leave of less than five (5) days.
Failure to Return from Leave. An employee who fails to return to duty upon completion of an unpaid leave of absence may be dismissed by the District, unless the employee was unable, due to causes beyond the employee’s control, to return to duty, in which event the employee must report the circumstances in writing to the District as soon as possible.
