Failure to Return from Leave. Any employee who is granted a leave of absence and who fails to return to work at the expiration of said leave of absence, shall be considered as having resigned his position with the City, and his position shall be declared vacated; except and unless the employee, prior to the expiration of his leave of absence, has requested an extension and furnished evidence that he is unable to work by reason of sickness, physical disability, injury or other legitimate reason beyond his control.
Failure to Return from Leave. Any employee who has been granted any type of unpaid leave of absence and who, for any reason, fails to return to work at the expiration of said leave of absence shall be considered as having resigned her or his position with the County, and her or his position shall thereupon be declared vacated, except and unless she or he has furnished evidence that she or he was unable to return to work for reasons protected by applicable Federal or State laws.

After an absence without leave for three (3) or more working days, their position shall thereupon be declared vacant and the employee terminated unless the employee, prior to the expiration of their leave of absence, has furnished evidence that they are unable to return to work by reason of sickness, physical disability or other legitimate reasons beyond their control. For reasons of sickness or physical disability, such leave requests shall be reviewed under Article 8, Section 7(B). For reasons not related to medical issues, such leave requests shall be decided by the department head and shall not exceed one (1) year.
Failure to Return from Leave. An employee who fails to return to duty upon completion of an unpaid leave of absence may be dismissed by the District, unless the employee was unable, due to causes beyond the employee’s control, to return to duty, in which event the employee must report the circumstances in writing to the District as soon as possible.

Failure to Return from Leave. The failure of an employee to return to work upon expiration of FMLA will subject the employee to termination unless an extension is granted. An employee who requests an extension of FMLA leave due to the continuation, recurrence or onset of her or his own serious health condition, or of the serious health condition of the employee's spouse, child or parent, must submit a request for an extension, in writing, to the employee's immediate supervisor. This written request should be made as soon as the employee realizes that she or he will not be able to return at the expiration of the leave period. Medical certification or recertification will be required in connection with requests for leave extension.
