Citys Rights and Obligations. 4.1. City agrees to authorize the Chief of Police to appoint the extra officer effective at the beginning of the contract term, so as to enable (but not require) the Chief of Police to appoint the extra officer to devote 187 days of his/her working time to Tomball Independent School District facilities ("the area"). As used herein, the phrase "working time devoted to the area" means the usual or normal hours that extra officer is required to work in any calendar month and does not include any extra or overtime work. The time the extra officer is on duty within the area, the time the extra officer is in court in connection with cases arising out of events occurring within the area, the time the extra officer spends preparing reports and documents pertaining to events occurring in the area, the time the extra officer spends in making preparations to provide law enforcement in the area, the time the extra officer spends transporting persons arrested in the area to jail, the time the extra officer spends investigating crimes or possible crimes committed in the area, are deemed working time devoted to the area. The activities listed above are explanatory and the meaning of "working time devoted to the area" is not limited to those activities.

The firefighters shall begin serving at the Xxxxxxxx Station as soon as feasible on the effective date of this contract following the recruitment and hiring process of the nine (9) firefighters for the Xxxxxxxx Road Station as it is within six (6) months prior to the completion of the Xxxxxxxx Station. The City will carry the appointment of the firefighters and be responsible for ensuring compliance with all applicable licensure requirements as defined by the Texas Occupations Code and the Texas Commission on Fire Protection.

The City will invoice and receive the Town’s approved solid waste, recycling, and yard waste fees (the “Town’s Fees”) to properties designated in writing by the Town, in the form and manner specified by the City, on the schedule and in the manner that the City bills for water and wastewater utility services. The City shall have no responsibility to invoice the Town’s Fees due and owing to the Town for any property not designated pursuant to the Billing Agreement by the Town for the billing of the Town’s Fees by the City.

Citys Rights and Obligations. Any time the CITY determines, in the sole exercise of its discretion, that the detention facility is not properly cleaned, maintained and/or otherwise kept in good repair, the CITY shall give reasonable notice to the Developer, the Association and their respective successors and assigns, including the individual lot owners within the Subdivision Plat or Development, that the detention facility needs to be cleaned, maintain and/or otherwise repaired. The notice shall provide a reasonable time to correct the problem(s). Should the responsible parties fail to correct the specified problem(s), the CITY may enter upon the Property to so correct the specified problem(s). Notice shall be effective to the above by the CITY’S deposit of the same into the regular United States mail, postage pre-paid. However, this Agreement does not expressly impose on the CITY a duty to so inspect, clean, repair or maintain the detention facility.
