Rights Upon Recall Sample Clauses

The 'Rights Upon Recall' clause defines the entitlements and procedures that apply when an employee or party is recalled to their position or role after a period of absence, such as a layoff or leave. Typically, this clause outlines the conditions under which recall occurs, the timeframe for responding to a recall notice, and the rights to reinstatement, including pay, benefits, and seniority. For example, it may specify that an employee must respond within a certain number of days to accept the recall or risk forfeiting their position. The core function of this clause is to ensure both parties understand their obligations and protections during a recall process, thereby reducing disputes and providing clarity on employment status and benefits upon return.
