Responsibility of User. 1. Inspect the park area, facilities and/or buildings immediately prior to park use to determine whether or not the area is suitable and safe for the recreational use intended. If such inspection reveals that such area is not suitable and safe for the intended use, the area shall not be used until the area is made suitable and safe for such use.

Responsibility of User. The portions of the posted highways and appurtenances shall be maintained to a level consistent with the existing state of repair and requirements included in the attached Exhibit “A.” The USER may be required to provide a maintenance plan detailing expected maintenance procedures and related items to be employed by the USER. The Exhibit “A” may include a maintenance plan or a reference to a maintenance plan, which if referenced shall be a part of Exhibit “A” as though physically attached. The nonperformance of normal maintenance by the POSTING AUTHORITY shall under no circumstances constitute grounds for an offset or credit against any excess maintenance, preventative maintenance or restoration responsibilities of the USER. The posting authority shall determine in its discretion whether the excess and preventative maintenance and restoration are satisfactory.
Responsibility of User. 4. The portion(s) of posted highway(s) and appurtenances shall be maintained to a level consistent with the existing state of repair at the time of the initial inspection. Preventative Maintenance projects to improve the posted highway beyond the existing state of repair may be performed pursuant to the authority granted by this Agreement, but the POSTING AUTHORITY may not require a USER to upgrade the condition of the posted highway beyond the existing state of repair without the USER’s consent. The USER may be required to provide a Maintenance Plan detailing expected maintenance procedures and related items to be employed by the USER and made a part of this agreement as though physically attached. The nonperformance of normal maintenance by the POSTING AUTHORITY shall under no circumstances constitute grounds for an offset or credit against any excess maintenance, preventative maintenance or restoration responsibilities of the USER. Responsibility of User. It is the responsibility of the User to leave the Facility and Premises clean and in orderly fashion or the group may be at risk of denial for future reservations. Report unsafe conditions in the area to the Division of Parks as soon as practical. Have at least one person present at the park area used at all times who is designated as "in charge" of the event taking place. That person shall be familiar with the terms of this agreement and the rules of the park. Warn all persons using the area, facilities and/or buildings under the authority of this agreement of any unsafe conditions which may exist or portions of that area which are not suitable for use. Supervise and control all persons using area under authority of this agreement. Require all persons under applicant's control to use area in accordance with County Park Regulations, a copy of which is hereby acknowledged by applicant. OBEY ALL COUNTY, STATE AND FEDERAL LAWS. Xxxx all orders and instructions from Park employees and/or Sheriff Deputies. Be financially responsible for any damage to the Park and its buildings and structures which are caused by negligent or intentional acts of persons using area under authority of this agreement. Absolve Kenosha County and Kenosha County Division of Parks of any liability that might occur while using this area under authority of this agreement. Clean area following use. IMMEDIATELY, upon personal notification to the person in charge of the event that the Division of Parks revokes permission under this agreement due to injury to person or property, imminent danger of such injury, or violation of park rules, the person in charge shall, in an orderly manner, stop the event and clear the area of persons using the Premises under this agreement.
Responsibility of User. The User is the only party responsible for the use of the System Product for the User's activities. The User agrees to use the necessary verification controls and operating techniques to satisfy its needs with respect to error detection, security, back-up and restart in case of failure or destruction of the User's software, the System Product or any of the User's files and data. Responsibility of User. The portion(s) of Municipal highway(s) and appurtenances shall be maintained to a level consistent with the attached cross‐section identified as “Type ”, and the portion(s) of Municipal highway(s) and appurtenance shall be restored to a level consistent with the attached cross‐secion(s) shall be attached to this Agreement as Schedule A and made a part hereof. The USER’S responsibility shall only extend to excess maintenance and restoration. The nonperformance of normal maintenance by the Municipality shall under no circumstances constitute grounds for an offset or credit against any excess maintenance or restoration responsibilities of the USER. If the USER selects Paragraph 6, Option B (below), the Municipality shall determine, in its discretion, whether the excess maintenance and restoration are satisfactory.
Responsibility of User. You are responsible for any misuse of the Service committed through your account or utilizing your HJSHS Equipment. You must take steps to ensure that unauthorized access to the Service does not occur, such as, for example and without limitation, strictly maintaining the confidentiality of your Service login and password. You are considered the registered recipient of the Service until you terminate this Agreement, or the Service is otherwise terminated for any reason at any time, and you will be liable for any prices, fees and charges incurred by the use of your HJSHS Equipment by anyone else until such termination, unless otherwise provided by applicable law. You may not assign or transfer the Service without HJSHS’s prior written consent. If you do, HJSHS may deactivate the Service. If your HJSHS Equipment is stolen or otherwise removed from your premises without your authorization you must notify HJSHS immediately, and you may be liable for payment for unauthorized use of the Service or your HJSHS Equipment.

Responsibility of User. The portions of the Township’s highways referenced above together with the associated appurtenances shall be maintained to a level consistent with the quality existing immediately prior to the issuance of the permit to the User. The User’s responsibility shall extend only to excess maintenance and restoration. However, the non-performance of normal maintenance by the Township shall under no circumstances constitute grounds for an offset or credit against any excess maintenance or restoration responsibilities of the User.

The portions of roads, streets and highways, rights-of-way, and appurtenances shall be maintained to a level consistent with the condition of the roads, streets and/or highways as of the date of this Agreement. The User specifically agrees that it shall limit its use of Township roads, streets and highways to those portions of Township roads, streets and highways described in Section 1, above, and further agrees that exceeding such license by its agents, servants, employees or contractors shall constitute a breach of this Agreement and that the User shall be responsible for securing additional permission, furnishing additional security and assuming responsibility for the damage to any portions of such additional Township roads, streets or highways.
