Notification of Discharge. The Lessee shall immediately notify the Department of Environmental Conservation (ADEC) and AO by phone of any unauthorized discharge of oil to water, any discharge of hazardous substances (other than oil), and any discharge of oil greater than 55 gallons on land. All fires and explosions must also be reported immediately. If a discharge, including a cumulative discharge, of oil is greater than 10 gallons but less than 55 gallons, or a discharge of oil greater than 55 gallons is made to an impermeable secondary containment area, the lessee shall report the discharge within 48 hours. Any discharge of oil greater than one gallon up to 10 gallons, including a cumulative discharge, solely to land, must be reported in writing on a monthly basis. Notification of discharge during normal business hours must be made to the nearest ADEC Area Response Team: Anchorage (000) 000-0000, fax (000) 000-0000; Fairbanks (000) 000-0000, fax (000) 000-0000; Juneau (907) 000-0000, fax (000) 000-0000. For discharges in state offshore waters call (000) 000-0000.The ADEC oil spill report number outside normal business hours is (000) 000-0000. Notification of discharge must be made to the appropriate DNR Office: Anchorage (000) 000-0000, fax (000) 000-0000; Fairbanks (000) 000-0000, fax (000) 000-0000, email xxx.xxx.xxxxx@xxxxxx.xxx; Juneau (907) 000- 0000, fax (000) 000-0000. The Lessee shall supply the AO with all incident reports. Should any unlawful discharge, leakage, spillage, emission or pollution of any type occur due to the Lessee’s actions or failure to act, the Lessee, at its expense, shall be obligated to clean the area to the reasonable satisfaction of the State of Alaska.

Notification of Discharge. The Employer shall notify the employee and Union of the intent to initiate discharge proceedings before the State Universities Civil Service Merit Board in accordance with the statute. Such notice shall satisfy the requirements of the collective bargaining Agreement and shall not, in any manner diminish the Employer’s or the employee’s rights under the State Universities Civil Service System. A grievance may be filed directly at Step 3 but must be submitted prior to or during the reconciliation meeting so that one meeting serves as a grievance hearing and a reconciliation meeting. State Universities Civil Service System procedures shall not commence until a grievance filed on the basis of intent to discharge has been responded to at Step 3. In the Step 3 response, the University shall outline the options available to the employee with respect to further pursuit of the matter. An employee notified of commencement of State Universities Civil Service System discharge procedures in accordance with this Agreement may either:
Notification of Discharge. If the Employer finds it necessary to initiate discharge or demotion proceedings against an employee covered by this Agreement, both the Union and the employee shall be notified of the intent to discharge/demote. If during the processing of the discharge/demotion through the State Universities Civil Service System process the employee wishes to protest such action, a grievance may be filed at Step 3 of the grievance procedure. The discharge/demotion proceeding shall not be finalized until the State Universities Civil Service System requirements have been met or the grievance, if one is filed, is responded to at Step 3.
