Limitations of Use. The Services and Atlantic Broadband Equipment, including any firmware or software embedded in Atlantic Broadband Equipment or used to provide the Services, are protected by trademark, copyright, and/or other intellectual property laws and international treaty provisions. You are granted a limited, non-sublicensable, non- transferable, revocable license to use such firmware and software in object code form (without making any modification thereto) strictly in accordance with the Agreement. You acknowledge and understand that you are not granted any other license to use the firmware or software embedded in Atlantic Broadband Equipment or used to provide the Services. You expressly agree that you will use Atlantic Broadband Equipment exclusively in connection with the Services. You shall not reverse, compile, disassemble, or reverse engineer or otherwise attempt to derive the source code from the binary code of the firmware or software. If you decide to use the Services through an interface device not provided by Atlantic Broadband, which Atlantic Broadband reserves the right to prohibit in particular cases or generally, you warrant and represent that you possess all required rights to use that interface device with the Services, including all software and firmware licenses. You will indemnify and hold harmless Atlantic Broadband against any and all liability arising out of your use of such interface device with the Services.

For the purpose of this Agreement, “Affiliate” shall mean, in relation to one entity (the first entity), any other entity which, directly or indirectly, controls, is controlled by or is under common control with, the first entity.

Furthermore, you undertake not to use any of the Works as a separate file and/or to present it as a separate file and/or make it available for download as a separate file or at all, in any manner whatsoever.
Limitations of Use. The District shall not, nor permit any of its authorized users to: (a) reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or algorithms underlying the Product; (b) modify, copy, translate, or create derivative works based on the Product or any of the content contained therein; (c) rent, lease, distribute, sell, resell, assign, or otherwise transfer rights to the Product; (d) use the Product for timesharing or services bureau purposes or otherwise for the benefit of a third party other than students or staff within the District’s organization; or (e) remove any proprietary notices from the Product. The District may not reproduce, upload, post, transmit, download or distribute any part of the Product content or information, or information accessed at other sites through links made from the Product, other than printing out or downloading portions of the text and images for use in connection with the work of the District’s organization. If the District’s users leave the Product via a link to a third party site, Curriculum Associates is in no way responsible for that third party site, and the District’s use of that third party site will be governed by that site’s terms of use, not this Agreement. The District must use the Product in compliance with all applicable laws, rules and regulations, including, without limitation, laws and regulations that govern the export of technical data outside of the United States.

You agree you will not 1) try to reverse engineer, disassemble, decompile, or decipher the Mobile App, XxxxXxxx.xxx or the Services or software making up the Mobile App, XxxxXxxx.xxx and Services, 2) navigate or search the Mobile App, XxxxXxxx.xxx or Services with any tool, software, agent, engine or other means (including bots, avatars, intelligent agents, or spiders), 3) use a means other than Exto’s provided interface to access the Mobile App, XxxxXxxx.xxx or the Services, 4) use the Mobile App, XxxxXxxx.xxx or the Services in a way that could impair, overburden, damage, or disable any portion of the Mobile App, XxxxXxxx.xxx or Services, or 5) mirror any material contained on the Mobile App, XxxxXxxx.xxx or the Services. Exto reserves the right to take various actions against you if we believe you have engaged in activities restricted by this Agreement or by laws or regulations, and Exto also reserves the right to take action to protect Exto, other users, and other third parties from any liability, fees, fines, or penalties. We make take actions including, but not limited to: 1) updating information you have provided to us so that it is accurate, 2) limiting or completely closing your access to the Mobile App, XxxxXxxx.xxx or the Services, 3) suspending or terminating your ability to use the Mobile App, XxxxXxxx.xxx or the Services on an ongoing basis, 4) taking legal action against you (note, as described in Section 9.3 Exto will not take action against you for failure to repay an Advance), 5) holding you liable for t...
