Limitations on Use. No part of the moneys delivered to the Recipient pursuant to Section II hereof is being or will be used to refinance, retire, redeem, or otherwise pay debt service on all or any part of any part of any governmental obligations regardless of whether the interest on such obligations is or was excluded from gross income for federal income tax purposes unless prior approval by the Director is given.
Limitations on Use. Each Party shall use, and cause each of its Affiliates, its licensees and its sublicensees to use, any Confidential Information obtained by such Party from the other Party, its Affiliates, its licensees or its sublicensees, pursuant to this Agreement or otherwise, solely in connection with the activities or transactions contemplated hereby.
Limitations on Use. Notwithstanding any other provisions in this Agreement, except with the written consent of VNDS, Registrar shall not: (i) sublicense the Licensed Product or otherwise permit any use of the Licensed Product by or for the benefit of any party other than Registrar, (ii) publish, distribute or permit disclosure of the Licensed Product other than to employees, contractors, and agents of Registrar for use in Registrar's domain name registration business, (iii) decompile, reverse engineer, copy or re-engineer the Licensed Product for any unauthorized purpose, (iv) use or permit use of the Licensed Product in violation of any federal, state or local rule, regulation or law, or for any unlawful purpose. Registrar agrees to employ the necessary measures to prevent its access to the System granted hereunder from being used to (i) allow, enable, or otherwise support the transmission by e-mail, telephone, or facsimile of mass unsolicited, commercial advertising or solicitations to entities other than Registrar's customers; or (ii) enable high volume, automated, electronic processes that send queries or data to the systems of VNDS or any ICANN-Accredited Registrar, except as reasonably necessary to register domain names or modify existing registrations.
Limitations on Use. 4.1. Licensee may use the Software only for Licensee's internal business purposes and only in accordance with the Documentation. Any other use of the Software is strictly prohibited. Without limiting the general nature of these restrictions, Licensee will not make the Software available for use by third parties on a "time sharing," "application service provider," or "service bureau" basis or for any other similar commercial rental or sharing arrangement.
Limitations on Use. You may not use, copy, modify, or distribute the Product, or make any copy, adaptation, transcription, or merge any portion thereof, unless expressly authorized by Gurobi in a separate written agreement. You may not reverse assemble, reverse compile, translate, or reverse engineer the Product. Your Product License may not be sold, transferred, leased, assigned, or sub-licensed without Gurobi’s prior written consent. If You copy or modify the Product in any way not expressly authorized by Gurobi, Your Product License is automatically terminated.
Limitations on Use. The Product/Service is licensed, not sold. Inogic reserves all other rights not expressly granted. While using the Product/Service, the Customer shall not do the following:
Limitations on Use. MIT shall use the Confidential Information solely for the purposes of the Research. Disclosure by Sponsor of the Confidential Information does not constitute a grant to MIT of any right or license to the Confidential Information except as set forth herein or in a duly executed license agreement.
Limitations on Use. Customer may not release to any third party any (i) Content, (ii) Deliverables or (iii) results of any evaluation of the Trial Services performed by or on behalf of Customer for purposes of monitoring its availability, performance or functionality, or for any other benchmarking or competitive purposes without the prior written approval of DMETRICS. Customer shall not (i) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the Trial Services, Deliverables or Content in any way; (ii) modify or make derivative works based upon the Trial Services Deliverables or Content; (iii) reverse engineer the Trial Services; (iv) create Internet “links” to the Trial Service or “frame” or “mirror” any content on any other server or wireless or Internet-based device; or (v) access the Trial Services in order to build a competitive product or service. Additionally, Customer shall not use the Trial Services to: (i) send spam or otherwise duplicative or unsolicited messages in violation of applicable laws; (ii) upload, send or store infringing, libellous or otherwise unlawful or tortious material, including material violative of third party privacy rights; (iii) upload, send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs, including any viruses or programming routines, macros, or other elements that may damage, surreptitiously intercept or expropriate any system, data or personal information; (iv) interfere with or disrupt the integrity or performance of the Services, Content or the data contained therein or or make use of the Service, Content or Deliverables in any manner not consistent with this Agreement; (v) attempt to gain unauthorized access to the Services or its related systems or networks; or (vi) access the Service for purposes of monitoring its availability, penetration or security testing, or any benchmarking or competitive purposes.
