Landlord to Furnish. Landlord shall furnish, subject to reimbursement pursuant to Article 5 above, (a) heating, ventilation and air conditioning to the Premises during the hours of 7:00 a.m. until 7:00 p.m. Monday through Friday (excluding holidays), (b) automatic elevator service to the floor or floors where the Premises are located at all times, and (c) water for drinking, cleaning and washroom purposes only at those points of supply shown on the approved plans for the Premises. Tenant shall be solely responsible for and shall promptly pay all other utilities and services supplied to the Premises to the extent such utilities and services are not part of the Additional Charges. Tenant acknowledges and agrees that the Premises may share electrical meters with other tenants, and Tenant shall reimburse Landlord, along with its Monthly Basic Rent and Additional Charges, for Tenant's prorata share of the costs of any such electrical service (calculated by dividing the Rentable Area of the Premises by the total rentable area covered by each such meter); provided that at no cost to Landlord, Tenant, as part of the Tenant Improvements and subject to the terms of Articles 7 and 31 including deduction of such costs from the T.I. Allowance, or during the Term as Alterations subject to the provisions of Article 10, may install separate electrical meters for the Premises and may separately zone (for purposes of HVAC) the Premises. Tenant shall, at its cost, be responsible for all janitorial service for the Premises. Except as otherwise provided herein, and subject to reimbursement pursuant to Article 5 above, Landlord shall at all times maintain all structural elements of the Building (including, without limitation, the roof, roof membrane, foundations, structural and exterior walls, window seals, skylights, roof vents and smoke hatches) and all central mechanical systems of the Building (including, without limitation, utilities, electrical and plumbing systems) in good working order and condition.

Tenant shall be solely responsible for and shall promptly pay all other utilities and services supplied to the Premises, including without limitation electrical service to the Existing Premises. Tenant acknowledges and agrees that the Expansion Premises share an electrical meter with other tenants, and Tenant shall reimburse Landlord for Tenant's prorata share of the costs of such electrical service (calculated by dividing the Rentable Area of the First Expansion Premises (5,695) and Second Expansion Premises (19,305), as applicable, by the total rentable area covered by such electrical meter (48,690)). Tenant shall, at its cost, be responsible for all janitorial service for the Premises.

Landlord to Furnish. Landlord covenants and agrees that it will, without additional charge, other than as included in Operating Expenses, furnish the following services during the Term at a level commensurate with the level at which such services are provided in Comparable Buildings.

Landlord shall furnish during the Term, subject to reimbursement pursuant to Article 5 above, (a) heating, ventilation and air conditioning to the Premises during the hours of 8:00 a.m. until 6:00 p.m. Monday through Friday (excluding recognized national or state holidays), (b) automatic elevator service to the floor or floors where the Premises are located at all times, (c) electric power at a rate of two and 65/100 (2.65) wxxxx per rentable square foot per 24 hour day, Monday through Friday (excluding recognized national or state holidays) in the Building, (d) hot and cold water, if any, at those points of supply shown on the approved plans for the Premises, (e) janitorial service five nights per week (except labor holidays) in accordance with Exhibit E attached hereto, (f) replacement of all building standard fluorescent rubes, and (g) landscaping services for the Premises and regular refuse removal from the Premises.

Landlord to Furnish. Landlord shall furnish to the Premises electricity, gas, domestic water and sewage services in amounts and in the capacity as is available at the Premises on the Effective Date. Based on representations by the utility provider to Landlord, Landlord warrants that there will be a dual feed power source available to the Premises as of the Commencement Date. In the event that such dual feed power source is not available to the Premises as of the Commencement Date, Tenant may, at is option, by written notice to Landlord prior to the expiration of thirty (30) days after such Commencement Date, and as its sole remedy, elect to obtain and install a Power Generator (as defined in Exhibit J hereof) for the Demised Premises, which Power Generator shall be subject to the provisions of Exhibit J hereto and the other terms and conditions of this Lease, except that Landlord shall reimburse Tenant for up to $40,000.00 of the costs of installing such Power Generator.
Landlord to Furnish. Tenant acknowledges that the Premises ------------------- is not separately metered for electricity and therefore Tenant shall pay its estimated prorata share of electrical usage to Landlord. Tenant's share of electricity is estimated at approximately $.153 per rentable square foot per month and shall be included on the monthly rent statement. The estimated rate is subject to adjustment based on changes in use or rate increases imposed by SDG&E. Tenant shall be permitted to separately meter the Premises for electricity at its own expense. The cost of sewer and water will be included in the Building Expenses unless separately metered for Tenant. Tenant will be responsible to provide, at its cost, janitorial service, including the refilling of soap, towel and tissue containers in the restrooms in the Premises.
