Second Expansion Premises Sample Clauses

Second Expansion Premises. Landlord will deliver the Second Expansion Premises to Tenant in broom clean condition, with Landlord’s Second Expansion Premises Work (as defined in the Second Expansion Premises Work Letter attached hereto as Exhibit B) substantially completed (other than the window blinds which shall be installed in the Second Floor Expansion Premises and the Third Floor Expansion Premises upon completion of Tenant’s Second Expansion Premises Work) and free of all other occupant’s rights thereto on or before the dates set forth in Section 3 below (i.e., March 1, 2007 for the Second Floor Expansion Premises, April 1, 2007 for the Third Floor Expansion Premises, and July 1, 2007 for the Fourth Floor Expansion Premises). On the Second Floor Expansion Premises Commencement Date (as defined hereinafter) the Premises, as defined in the Original Lease as amended by the First Amendment, shall be increased by 16,934 rentable square feet as a result of the Second Floor Expansion Premises, and the Second Floor Expansion Premises shall be deemed a part of the “Premises”; on the Third Floor Expansion Premises Commencement Date (as defined hereinafter) the Premises shall be further increased by 17,289 rentable square feet as a result of the Third Floor Expansion Premises, and the Third Floor Expansion Premises shall be deemed a part of the “Premises”; and on the Fourth Floor Expansion Premises Commencement Date (as defined hereinafter) the Premises shall be further increased by 17,289 rentable square feet, and the Fourth Floor Expansion Premises shall be deemed a part of the “Premises”, for an aggregate Premises Rentable Area of 103,437 rentable square feet.
Second Expansion Premises. In addition to the Original Premises, commencing on the Second Expansion Premises Commencement Date (as defined in Section 2 below), Landlord leases to Tenant, and Tenant leases from Landlord, that certain portion of the Building commonly known as Suite 540 containing approximately 2,976 rentable square feet, as more particularly shown on Exhibit A attached hereto (the “Second Expansion Premises”).
Second Expansion Premises. From and after the Second Expansion Premises Commencement Date, Tenant shall pay Base Rent with respect to the Second Expansion Premises, on a per-rentable-square-foot basis, using the applicable monthly rates set forth in the rent schedule contained in Section 5(d) below.
Second Expansion Premises. 5. Landlord and Tenant acknowledge that neither of them have retained the services of a broker or agent in connection with this Agreement.
Second Expansion Premises. (a) In consideration of the rents, terms, provisions and covenants of this Amendment and the Lease, Landlord hereby leases unto Tenant and Tenant hereby rents and accepts from Landlord the Second Expansion Premises. The Second Expansion Premises is more particularly described on Exhibit A attached hereto. The Second Expansion Premises is adjacent to the Existing Premises.
Second Expansion Premises. Commencing on the Second Expansion Premises Commencement Date, Tenant shall pay Base Rent for the Second Expansion Premises in the amount of $4.95 per rentable square foot of the Second Expansion Premises per month on a triple net basis. Base Rent payable with respect to the Second Expansion Premises shall be increased on each annual anniversary of the Second Expansion Premises Commencement Date (each, an “Third Amendment Adjustment Date”) by multiplying the Base Rent payable with respect to the Second Expansion Premises immediately before such Third Amendment Adjustment Date by 3% and adding the resulting amount to the Base Rent payable with respect to the Second Expansion Premises immediately before such Third Amendment Adjustment Date. Notwithstanding anything to the contrary contained herein, for the period commencing on the Second Expansion Premises Commencement Date (or, if the Second Expansion Premises Commencement Date occurs on a date other than the first day of a calendar month, commencing on the first day of the first full calendar month following the month in which the Second Expansion Premises Commencement Date occurs) through the expiration of the 12th full calendar month following the Second Expansion Premises Commencement Date, Tenant shall be required to pay Base Rent with respect to only 10,177 rentable square feet of the Second Expansion Premises (the “Partial Abatement Period”). Tenant shall commencing paying Base Rent with respect to the entire Second Expansion Premises on the day immediately following the expiration of the Partial Abatement Period.

Second Expansion Premises. Commencing on the Second Expansion Premises Rent Commencement Date, Tenant shall commence paying Base Rent per rentable square foot per month with respect to the Second Expansion Premises at the same rate per rentable square foot per month that Tenant is then paying with respect to the Existing Premises, as adjusted pursuant to Section 4 of the Lease.

Second Expansion Premises. Effective as of Second Expansion Date, Tenant hereby leases from Landlord, and Landlord hereby leases to Tenant, the Second Expansion Premises. As used herein, the term “Second Expansion Premises” shall mean approximately 8,971 rentable square feet of office space, as shown on the plan attached hereto as Exhibit A as “Vapotherm 2nd Expansion est. 8,971 SF”. The First Expansion Premises and the Second Expansion Premises shall be collectively referred to herein as the “Expansion Premises”. Prior to the Second Expansion Date, each party shall have the right to have the rentable square feet of the Second Expansion Premises measured in accordance with the terms of the Existing Lease. Effective as of the Second Expansion Date, and continuing through the expiration or earlier termination of the term, Tenant shall be entitled to possession of the Original Premises and the Expansion Premises, and all references in the Lease to the “Premises” shall refer collectively to the Original Premises and Expansion Premises, and shall consist of a total of 79,952 rental square feet (subject to each party’s right to re-measure the Second Expansion Premises).
