Customer Delays. If a Customer’s act or omission delays the Service Commencement Date, then Vodafone may start billing Recurring Charges from the Agreed Delivery Date and charge Customer for Vodafone’s reasonable costs (including Third Party Provider costs) that result from the delay. Alternatively, Vodafone reserves the right to review and amend the Charges. Examples of Customer delays shall include, but not be limited to, Customer’s failure to: (a) provide complete or accurate information, access, or assistance as reasonably required; (b) complete necessary works resulting from a Site Survey; or (c) procure and maintain Mandatory Accompanying Services or Technical Prerequisites. If the delay extends 60 Working Days beyond the original Agreed Delivery Date, Vodafone may terminate the Service and apply a Recovery Charge. If appropriate, Vodafone may set and/or revise an Agreed Delivery Date.
Customer Delays. If action or inaction by Customer, or its suppliers’ failure to perform their responsibilities in a timely manner, prevents CGI from or delays CGI in performing the Services, CGI will be entitled to an equitable adjustment in the schedule for performance and the compensation otherwise payable to it under the applicable Statement(s) of Work. In such event, the parties will mutually agree upon a Change Order documenting the adjustments.
Customer Delays. In the event of any delay in Customer’s performance of any of the obligations set forth in this License Agreement or any other delays caused by Customer, the milestones, fees and date(s) set forth in the Order Form shall be adjusted as reasonably necessary to accommodate such delays.
Customer Delays. Customer shall be entitled to request a delay or postponement to the Launch Date up through [***...***], but subject to the delay liability fees provided for in this Section 11.2. If Customer’s request for a delay or postponement to the Launch Date occurs following [***...***]. Regardless of the request for delay or postponement by Customer, with the exception of the final payment owed to SpaceX for Launch under Section 5.1, Customer payments shall continue in accordance with the Payment Schedule established in Section 5.1. If Customer causes or requests any delay to the Launch Date for any particular Launch Service that is not an Excusable Delay as provided in Section 11.1, whether with respect to the Payload or otherwise, including delays due to Customer’s contractors or subcontractors, exceeding three hundred sixty-five (365) Days beyond the last Day of the Launch Period for such Launch Service, or beyond any subsequent Launch Date for such Launch Service as duly established by the Parties or the last Day of any subsequent Launch Period for such Launch Service, whichever is earlier, separate and distinct from any necessary and documented expense reimbursement as provided for in this Section 11.2, Customer agrees pay to SpaceX delay liability fees based on the following schedule:

Excluding Excusable Delays and irrespective of SpaceX launch readiness, if Customer’s actual launch readiness is delayed for a period exceeding one hundred eighty (180) days (in the aggregate) beyond the last day of an applicable Launch Period (or if Customer requests such delay), Customer agrees to pay SpaceX delay fees based on the following schedule: [***…***]. Any fractional month(s) shall be calculated on a pro rata basis and nothing in this Section 9.2 (Customer Delays) shall be construed as permitting delayed payment of any amounts owed by Customer hereunder. Customer Delays. If Customer causes or requests any delay that is not an Excusable Delay exceeding (***) (in the aggregate) beyond the Launch Date, Customer agrees to pay Contractor delay fees based on the following schedule: (a) (***); (b) (***); and (c) (***). Any fractional month(s) shall be calculated on a pro-rata basis and nothing in this Section 11.2 (Customer Delays) shall be construed as allowing for delayed payment of any amounts owed by Customer hereunder. (***). Contractor shall not be responsible for Payload or customer equipment storage costs in the event of a delayed Launch whether or not such delay is an Excusable Delay. (***).
Customer Delays. In the event that Company is delayed in the performance of the work due to the fault of Customer, its employees, servants, agents or contractors of the purchaser other than Company, Company shall be entitled to be reimbursed for any costs it incurs as a result of any such delay. Time and Material rates for labor and equipment shall apply. This Quotation shall be subject to availability of appropriate equipment.
Customer Delays. If Customer, or any third party acting on Customer's behalf does not provide any required item or service to Sagent on a timely basis in accordance with the schedule set forth in the Statement of Work, then the dates set forth which have been directly or indirectly affected by such delay shall be extended as necessary to account for such delay.
Customer Delays. If action or inaction by Customer, or its suppliers’ failure to perform their responsibilities in a timely manner, delays or prevents Cayuse from performing the Professional Services or Custom Development, Cayuse will be entitled to a Change Order documenting an equitable adjustment in the schedule for performance and the Fees under the applicable SOW.
Customer Delays. If performance by Licensor (or its licensor) under any Statement of Work is delayed as a result of any failure of Customer to provide appropriate information, resources, or personnel reasonably necessary for Licensor's (or its licensor’s) performance, appropriate adjustments to the applicable performance schedule may be made and any reasonable costs or expenses incurred may be charged to the Customer.
