Vacation, Holiday and Personal Leave. The Superintendent may take, at the Superintendent’s choice and subject to Board approval, ten (10) days of vacation per year during the term of this Contract. At the conclusion of each contract year, the Superintendent may choose to either: 1) continue any accumulated vacation days to the following contract year; or 2) receive a pro-rated daily amount for accumulated vacation days based upon the salary amount identified in paragraph 3.1 above. Vacation days taken by the Superintendent will be taken at such time or times as will least interfere with the performance of the Superintendent’s duties as set forth in this Contract. The Superintendent shall observe the same legal holidays as provided for other administrative employees on twelve-month contracts. The Superintendent is hereby granted the same personal leave benefits as authorized by Board policies for administrative employees on twelve-month contracts.

Vacation, Holiday and Personal Leave. The Superintendent may take, at the Superintendent’s choice, subject to notice to the Board, fifteen (15) days of vacation per year, with the days to be in a single period or at different times. The vacation days taken by the Superintendent will be taken at such time or times as will least interfere with the performance of the Superintendent's duties as set forth in this Contract. The Superintendent shall observe the same legal holidays as provided by Board policies for administrative employees on twelve-month contracts, and in the absence of such policies the Superintendent shall observe the same legal holidays as authorized and set forth by the Board annually in connection with the Board’s adoption of the District’s annual calendar. The Superintendent is hereby granted the same personal leave benefits as authorized by Board Policy DEC (LEGAL and LOCAL), and/or such other Board policy or policies as may be adopted by the Board from time to time. Subject to the limitations contained in this section and in applicable Board policy, the Superintendent may carry forward and accumulate unused vacation and personal leave days from year to year during the term hereof. Upon leaving the District the Superintendent will be reimbursed for all accrued but unused vacation and personal leave days (not to exceed 45 total days) at the daily rate of pay of his final contract year.

Vacation, Holiday and Personal Leave. 16.1 For Battalion Chief Bargaining Unit members employed by the City of Xxxxxx, the accruals may vary from one pay period to the next based on the regular hours worked or whether the employee is in a paid status during the pay period. For Battalion Chief Bargaining Unit Members employed by the City of Springfield, the same number of hours is accrued each pay period. Accrued vacation and holiday leave may not be used until the completion of the pay period in which it is earned. Employees are not eligible to use vacation and holiday leave until they have been employed for six (6) consecutive months.

The Superintendent may take the same number of non-duty days authorized by District policy for administrative employees who are employed under twelve-month contracts. The Superintendent may request payment for ten (10) days ofaccrued but unused vacation days on June 30 of each year during the term ofthis Contract, to be paid at the Superintendent's "Daily Rate," determined by dividing the Superintendent's then current annual TRS creditable compensation by 226. The term "legal holiday(s)" includes days for which the District's central administration office is closed. The Superintendent is hereby granted the same number of illness benefits and leave as authorized by Board policies for administrative employees on twelve-month contracts. Other than what is outlined in this paragraph, in the absence ofany subsequent written agreement specifically approved and signed by the Board, regardless of any current or future board policy relevant to compensation for leave days upon separation from employment, as part ofthe consideration ofthis Contract, the Superintendent is not entitled to any monetary compensation for any outstanding unused leave days upon his separation from employment with the District.
