Underground Obstructions. Without prejudicing or limiting the provisions of the preceding paragraph (b)(i) or of Section 10.1 (“Project Schedule”), Seller shall be responsible for ascertaining the location of and avoiding damage to all underground installations including without limitation cable, gas, water pipes, telephone lines, and other underground installations, whether the location of the excavation, digging, or trenching required for performance of the Work is fixed by Buyer or by Seller. Seller shall be responsible for all delays, costs, loss and/or expense arising, whether directly or indirectly, from any ground conditions or artificial obstructions or hazards (excluding hazardous materials encountered by Seller during the execution of the Work) including any Work underground or involving excavation that Seller should have been made reasonably aware of based on information available and Seller shall not be entitled to any additional Cost, any extension to the Time for Completion or any increase in the Purchase Price as a result thereof.

Underground Obstructions. Without prejudicing or limiting the provisions of Section 3.1(b)(i) or Section 10.1, Developer shall be responsible for ascertaining the location of and avoiding damage to all underground installations including cable, gas, water pipes, telephone lines, and other underground installations, whether the location of the excavation, digging, or trenching required for performance of the Work is fixed by PacifiCorp or by Developer. Developer shall be responsible for all delays, costs, loss or expense arising, whether directly or indirectly, from any ground conditions or artificial obstructions or hazards, including Regulated Materials encountered by Developer during the execution of the Work and including any Work underground or involving excavation that Developer should have been made reasonably aware of based on information available and Developer shall not be entitled to any adjustment as a result thereof to either the Contract Price or the Project Schedule.
Underground Obstructions. The Contractor shall anticipate all underground obstructions such as water lines, gas lines, sewer lines, utility lines, concrete and debris. No extra payment will be allowed for the removal, replacement, repair or possible increased cost caused by underground obstructions. Any such lines or obstructions indicated on the map show only the approximate locations and must be verified in the field by the contractor. The Owner and his authorized representative will endeavor to familiarize the Contractor with all known underground utilities and obstructions, but this will not relieve the Contractor from full responsibility in anticipating all underground obstructions.
Underground Obstructions. 7.1 Water District is not responsible for and does not assume any responsibility or liability whatsoever for School District’s (or its contractors’) acts and omissions during the design and construction of the Infrastructure Improvements. Any location of underground utility lines or surface obstructions given to School District or placed on the project drawing by Water District are for School District's convenience, and must be verified by School District in the field. Water District assumes no responsibility for the sufficiency or accuracy of such information, lines, or obstructions.

Except (i) as provided otherwise herein or (ii) in the case of any ground conditions or artificial obstructions or hazards that could not have been reasonably anticipated by Contractor or that have not been previously disclosed to Contractor by Company, Contractor shall be responsible for all delays, Costs, loss or expense arising, whether directly or indirectly, from any ground conditions or artificial obstructions or hazards including any Work performed underground or involving excavation and Contractor shall not be entitled to adjustment to either the Contract Price or the Project Schedule.
Underground Obstructions. The District requires the Applicant to use Underground Service Alert to identify any underground utilities prior to beginning any construction of the Improvements or testing of the Improvements. All locations of underground utility lines or other underground obstructions shall appear on the Plans and Specifications for the Improvements, but must be verified by the Applicant in the field. The District does not assume any responsibility or liability whatsoever for the sufficiency or accuracy of information obtained by the Applicant with respect to locations of underground service lines or other obstructions.

Contractor shall be responsible for all delays, costs, loss and/or expense arising, whether directly or indirectly, from any ground conditions or artificial obstructions or hazards (excluding hazardous materials encountered by Contractor during the execution of the Work that were not previously identified in writing by Owner), including any Work underground or involving excavation. Contractor shall not be entitled to any additional costs, any extension of any Project Guaranteed Date or any increase in the Contract Price as a result of any underground conditions or obstructions, except upon the conditions set forth in Section 4.9.
Underground Obstructions. The Builder shall protect all existing buried facilities. Conduit may go over, under, or around various existing facilities encountered underground as long as there is a minimum separation of twelve (12) inches and the minimum trench depth requirements are met, unless greater separation is required by the permitting agency. If the cable running line varies, the Builder shall place buried cable markers at direction changes. If the minimum separation requirements cannot be met, mechanical protection shall be placed surrounding the TOUCH AMERICA plant.
