TERMS AND CONDITIONS OF WARRANTY. Eye exams must be performed by a Board Certified Veterinary Ophthalmologist and documents must be supplied to Breeder.  Sub-aortic Stenosis must be confirmed by Echocardiography and Doppler and performed by a Board Certified Veterinary Cardiologist and documents must be supplied to Breeder.  Hip and/or Elbow Radiographs must be submitted to and examined by the Orthopedic Foundation For Animals and results must be supplied to Breeder.  Environmental factors, like high caloric diet during the rapid growth phase, may exacerbate changes in dysplastic hips or elbows. Therefore the Breeder refuses to take responsibility for dysplasia in an overweight puppy and thus Xxxxx will not qualify for a replacement puppy. Veterinarian records must be made available to prove good weight control.  No replacement will be given if the puppy has not been examined by 24 months of age.  Warranty is NULL AND VOID if the puppy has been bred or this contract has not been followed.  Any breach of these contract terms are subject to a $5000 penalty and mandatory return of the puppy. This document represents the entire agreement between the Breeder and the Buyer. No other promises or guarantees are made. The conditions of this agreement may only be changed in writing by mutual consent of both parties. This document shall be enforced only in the State of Ohio, where the transaction has officially taken place. THE BUYER HAS READ AND UNDERSTANDS THE FULL REGISTRATION SALES AGREEMENT IN ITS ENTIRETY AND AGREES THAT ALL PARTS AND PORTIONS THEREOF CONSTITUTE A BINDING AGREEMENT. TERMS AND CONDITIONS OF WARRANTY. Rollease Acmeda provides a Warranty for the Products and the Components purchased by the Customer for external applications intended to be acquired for the purpose of re-supply, or using or transforming them in trade or commerce in the course of production or manufacture or repairing or treating other goods or fixtures on land. PRODUCTS The products (components and hardware) subject to this Warranty are: S100 EXTREME WIRE GUIDE SYSTEM The Products and the Components are covered for defect in materials, workmanship or failure to operate. To make a claim under this Warranty, the Customer must notify Rollease Acmeda in writing of their claim and provide sufficient information to enable Rollease Acmeda to identify the issue, together with proof of purchase. The Customer must return the Products and/or Components to Rollease Acmeda for assessment. Subject to the Australian Consumer Law contained in the Competition and Consumer Act 2010 (“ACL”), Rollease Acmeda will, at its discretion, repair or replace any Products or Components assessed to be defective. This Warranty does not cover: • Abuse to the Products or Components such as alterations, accidents, misuse. • Installation, use, maintenance or modifications outside of the Product or Components specifications. • Fair and reasonable wear and tear. • Damage resulting from accidents or the negligence of the Customer or any third party. • Damage resulting from the alteration of preset operating parameters caused by acts of nature, accidents, negligence, improper installation or otherwise. • Deterioration of finished surfaces due to exposure to ocean salt spray (except as set out below) or other corrosive atmosphere including hazardous industrial processes; • Labour, access, third party or electrical costs borne by the Customer to complete repairs, maintenance or replacement of components that make up the Product supplied by Rollease Acmeda; • Any component added to the Product that was not supplied by Rollease Acmeda including motorisation componentry or any damage to the Product caused thereby.
