We will provide the required Data & Internet Services and its coverage subject to availability, geographical and technical capability, lack of capacity and faults in other telecommunications networks to which the Data & Internet Service is connected. There may also be times when maintenance being performed on the Services limits availability. We are not obliged to provide you with Data & Internet Services where capacity, geography or technical capability, affect the application or installation of the Service to your premises. Certain Data & Internet Services, coverage may only be available in selected metropolitan and regional areas. We do not warrant that the Data & Internet Services will be free of interruption, delays or faults. You acknowledge and agree: that certain Data & Internet Service is not suitable for (and is not supplied for the purpose of) supporting any application which needs continuous fault free service; that you are responsible for making your own assessment of whether you need continuous fault free services and obtaining and implementing advice about alternative telecommunication services suitable for such purposes; and that it is your responsibility to protect your network from viruses, malware or any other forms of intrusion. We are not obliged to provide Data & Internet Services to you if the physical infrastructure of your premises or site does not pass service qualification by our Supplier or if it is found to be unsuitable as a result of a feasibility study. You agree to receive the Data & Internet Services for the Minimum Term specified in your Application, subject to your rights specified in this SFOA. The Minimum Term commences on the date we activate your Data & Internet Services. We will use reasonable endeavours to meet the response target where Service Level Agreements are advertised and/or advised by us. We will use all reasonable endeavours to provide you with information regarding the progress of resolving any reported fault, but you acknowledge that we are only required to do so if any new information is available.   • Internet Services Transfer Agent shall make available to Fund and Shareholders, through its web sites, including but not limited to xxx.xxxxxxxxxxxxx.xxx (collectively, “Web Site”), online access to certain Account and Shareholder information and certain transaction capabilities (“Internet Services”), subject to Transfer Agent’s security procedures and the terms and conditions set forth herein and on the Web Site. Transfer Agent provides Internet Services “as is,” on an “as available” basis, and hereby specifically disclaims any and all representations or warranties, express or implied, regarding such Internet Services, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance.   • Web Services Our Web Services are designed to enable you to easily establish a presence on the Internet.   • Cable Television, Telephone & Internet Services Long Distance calling may be done only through the use of a prepaid phone card or by charges made to a third party number if using a provided, in room telephone. Neither the Institution nor the Manager guarantees the availability of telephone service or cable television services. If the Resident wants additional cable television, telephone or internet service above and beyond any that may be provided as “standard” in the Residence, the Resident must submit full details to and request and obtain the prior written approval of the Manager and Institution. With respect to Internet Services, the Institution may at its discretion only allow either the standard provided service or the approved alternate service and not both at the same time (Residents will need to complete the Institution’s standard forms issued by their IT department). Cutting of wiring, boring of holes, the use of wireless routers, routers, or switches are not permitted. Any unauthorized services or equipment may be removed by the Manager, at the Resident’s expense, without notice or liability. All Residents are subject to the Institution’s and/or Service Provider’s current Internet, cable television and telephone enrolment and usage policies.

  • Hosting Services 13.1 If Supplier or its subcontractor, affiliate or any other person or entity providing products or services under the Contract Hosts Customer Data in connection with an Acquisition, the provisions of Appendix 1, attached hereto and incorporated herein, apply to such Acquisition.

  • Online Services Microsoft warrants that each Online Service will perform in accordance with the applicable SLA during Customer’s use. Customer’s remedies for breach of this warranty are in the SLA. The remedies above are Customer’s sole remedies for breach of the warranties in this section.   • Use of Verizon Telecommunications Services 2.1 Verizon Telecommunications Services may be purchased by Connectel under this Resale Attachment only for the purpose of resale by Connectel as a Telecommunications Carrier. Verizon Telecommunications Services to be purchased by Connectel for other purposes (including, but not limited to, Connectel’s own use) must be purchased by Connectel pursuant to other applicable Attachments to this Agreement (if any), or separate written agreements, including, but not limited to, applicable Verizon Tariffs.

  • Conversion of Wholesale Services to Network Elements or Network Elements to Wholesale Services Upon request, BellSouth shall convert a wholesale service, or group of wholesale services, to the equivalent Network Element or Combination that is available to Global Dialtone pursuant to Section 251 of the Act and under this Agreement or convert a Network Element or Combination that is available to Global Dialtone pursuant to Section 251 of the Act and under this Agreement to an equivalent wholesale service or group of wholesale services offered by BellSouth (collectively “Conversion”). BellSouth shall charge the applicable nonrecurring switch-as-is rates for Conversions to specific Network Elements or Combinations found in Exhibit A. BellSouth shall also charge the same nonrecurring switch-as-is rates when converting from Network Elements or Combinations. Any rate change resulting from the Conversion will be effective as of the next billing cycle following BellSouth’s receipt of a complete and accurate Conversion request from Global Dialtone. A Conversion shall be considered termination for purposes of any volume and/or term commitments and/or grandfathered status between Global Dialtone and BellSouth. Any change from a wholesale service/group of wholesale services to a Network Element/Combination, or from a Network Element/Combination to a wholesale service/group of wholesale services, that requires a physical rearrangement will not be considered to be a Conversion for purposes of this Agreement. BellSouth will not require physical rearrangements if the Conversion can be completed through record changes only. Orders for Conversions will be handled in accordance with the guidelines set forth in the Ordering Guidelines and Processes and CLEC Information Packages as referenced in Sections 1.13.1 and 1.13.2 below.

  • Processing of Data You acknowledge and agree that with each use of the Service initiated by your xxxxxxxxxx.xxx authenticated Users the Service will access Your xxxxxxxxxx.xxx account to retrieve, store, manipulate, process and modify Customer Data based on Your configuration of the Service (“Process”) and You expressly consent to such access solely as is necessary to provide the Service or Support Services. If the Service cannot for any reason access Your xxxxxxxxxx.xxx account, Conga will be excused from any nonperformance of the Service. You acknowledge that to provide the Service, Customer Data leaves the xxxxxxxxxx.xxx system. Xxxxxxxxxx.xxx is not responsible for Customer Data when it is outside of the xxxxxxxxxx.xxx system.
