Your Responsibility. You are solely responsible for the quality, completeness, accuracy, validity and integrity of the image. You are solely responsible if you, intentionally or unintentionally, submit fraudulent, incorrect or illegible images to us or if Mobile Deposit is used, by authorized or unauthorized persons, to submit fraudulent, unauthorized, inaccurate, incorrect or otherwise improper or unusable images to us. In addition, you agree that you will not modify, change alter, translate, create derivative works from, reverse engineer, disassemble or decompile the technology or Service, copy or reproduce all or any part of the technology or Service; or interfere, or attempt to interfere, with the technology or Service. We and our technology partners, inclusive of, but not limited to, Q2 Software, Inc. (“Q2”) and Jack Henry & Associates, Inc. (“Jack Henry”), retain all rights, title and interests in and to the Services, Software and Development made available to you.
Your Responsibility. We are not responsible for any other type of direct loss that you may suffer or any other type of loss, damage, delay or inconvenience that you might suffer or incur in any of the following situations: (i) you fail to notify us that you suspect or aware that there has been misuse or unauthorized use of your Password or Personal Verification Questions; (ii) you provide us with inaccurate, incomplete, inadequate or erroneous information or data in connection with the Services (including as part of a request to process a Transaction); (iii) you are unable to access the Services for any reason (including as a result of a failure, error or malfunction even if caused by our negligence) or you experience a delay in using the Services; (iv) we do not receive your Instructions or we decline to act on your Instructions or we do not complete any Transaction; (v) we suspend or terminate your access to any of the Services; (vi) you fail to fulfill any of your other obligations under this Agreement or you fail to comply with any instructions that we provide to you; (vii) you engage in any fraud or dishonest or criminal acts in your use of the Services; (viii) your access to and use of the Third Party Services or any loss or inconvenience that results from us suspending access to Third Party Services.
Your Responsibility. You are solely responsible for scanning deposit items, accessing the Service from CU and for maintaining your own scanning equipment and mobile device. Not all scanning equipment/mobile device will produce a useable image. You will be responsible for the payment of all telecommunications expenses associated with the Service. CU shall not be responsible for providing or servicing any equipment for you. You are solely responsible for the quality, completeness, accuracy, validity, and integrity of the image. We and our technology partners, inclusive of, but not limited to, Intuit, Inc. and Ensenta Corporation, retain all rights, title and interests in and to the Services, Software and Development made available to you.

Your Responsibility. If you permit other persons to use any Service, you are responsible for any transactions they authorized from your accounts. Tell us AT ONCE if you believe your User ID or Password has been lost or stolen, or if you believe that someone has made payments, transferred or may transfer money from your account without your permission. Telephonic notification is the best way of keeping your possible losses down. You could lose all the money in your account. If you tell us within two business days, you can lose no more than $50 if someone used your User ID or Password without your permission. If you do NOT tell us within two business days after you learn of the loss or theft of your User ID or Password, and we can prove that we could have stopped someone from using your User ID or Password without your permission if you had told us, you could lose as much as $500. Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods.
Your Responsibility. Each time you make a Mobile Deposit you represent and warrant to Bank that:
Your Responsibility o You agree that you will use the Mobile Deposit Capture service to scan only Original Checks payable to and properly endorsed by you by signing your name(s) and writing “for mobile deposit only at Kentucky Bank" under your endorsement, drawn on financial institutions in the United States with a valid ABA/Routing Number and denominated inU.S. Dollars, and intended for deposit by you to your designated Account with Kentucky Bank. All other items may be deposited by alternate methods such as in person.o You understand that Kentucky Bank is not obligated to accept for deposit any Check Image that Kentucky Bank in its sole discretion determines to be ineligible for the Mobile Deposit Capture service. Ineligible items include: Check Images of items drawn on banks located outside the United States, Check Images that are illegible, images of checks previously converted to Substitute Checks (as defined by Check 21), and Check Images with unreadable magnetic ink character recognition ("MICR") information. The quality of any Check Image must comply with the requirements established from time to time by ANSI, the Board of Governors of the Federal Reserve Board, or any other regulatory agency, clearing house or association. You acknowledge and agree that even if Kentucky Bank does not identify a Check Image as ineligible, the Check Image may be returned to Kentucky Bank because, among other reasons, the Check Image or any Substitute Check created from the Check Image is deemed ineligible by the financial institution upon which it is drawn or any intermediate collecting financial institution. Kentucky Bank's failure to identify a Check Image you transmit to Kentucky Bank as ineligible shall not preclude or limit your obligations.o You shall fully destroy each Original Check in your Check Image deposit fourteen (14) days following receipt and crediting of your Check Image deposit or as Kentucky Bank may otherwise instruct. Prior to destruction you shall maintain each Original Check in a secure location. You understand each Original Check must be fully destroyed following any retention period and that a paper shredder is one such method to assure destruction. You are responsible if an Original Check is misused following submission by Check Image deposit and its full destruction.
Your Responsibility. You are responsible for all activity occurring under your user accounts (by you, your registered Student(s), or others) and shall abide by all applicable local, state, national and foreign laws, treaties and regulations in connection with your use of the Site and either or both of the Services, including, without limitation, those related to data privacy, international communications and the transmission of technical or personal data. You agree, during the term of this Subscription Agreement, to notify Whizz Education immediately of any unauthorized use of the Services of which you become aware or any other known or suspected breach of security.
