PRODUCT CONFORMANCE. Supplier agrees to supply Customer with quality Products that comply with the Specifications and the SynCardia-On-X Quality Agreement, attached in Appendix IV.

PRODUCT CONFORMANCE. All product received is subject to inspection by Xxxxxx. The product shall conform to specifications, drawings, and any other descriptions in the purchase order, and product shall be free from defects in material and workmanship. Nonconforming product discovered during Triman inspection shall be reported to the Supplier with removal and return disposition (at the expense of the Supplier) being transacted promptly after notification of the nonconformance.
PRODUCT CONFORMANCE. Seller agrees to notify CFD of any product which does not conform to the requirements of applicable drawings, specifications or Purchase Order requirements. Seller shall obtain CFD approval for disposition of said non- conforming product prior to shipment.
PRODUCT CONFORMANCE. All Product shall comply with the Release Specifications. In accordance therewith, each Batch of Product delivered to NeoRx shall be accompanied by or promptly followed by a Certificate of Analysis relating to such Batch. NeoRx may reject any Batch if University fails to comply with Release Specifications or fails to deliver a Certificate of Analysis along with such Batch, or if such Batch contains less than [*] of the activity ordered by NeoRx in the applicable Purchase Order. If NeoRx rejects a Batch for such reasons, NeoRx may return such Batch to University (at University’s cost). NeoRx shall not be obligated to pay for such rejected Batch (and shall not be obligated to pay for any shortfall below the Minimum Quantity resulting from such rejected Batches).
PRODUCT CONFORMANCE. 57.1 Supplier shall establish and maintain agreements with product safety certification bodies or agencies and/or their assigned representatives as required to support on-going product safety compliances for Products manufactured for Company under this Agreement. Compliance documentation required to support on-going compliance inspections at Supplier’s manufacturing location(s) will be provided and maintained by Company. Costs associated with such inspection agreements and for the periodic on-going inspections are the responsibility of the Company. Supplier shall have in place a quality process or program that specifically focuses on maintaining the on-going product safety compliance of Company’s certified Products.
PRODUCT CONFORMANCE. SELLER shall manufacture Product(s) listed in Attachment "A" to the requirements set forth in the specifications listed in Attachment "A". SELLER warrants that Products delivered under this Agreement shall conform 100% to the performance and design parameters of BUYER'S Specifications.
PRODUCT CONFORMANCE. Supplier shall be liable for compliance and all costs associated with all statutory regulations, requirements and other provisions as identified in Company's technical specification in connection with the Product to be delivered. This shall include, if designated in the technical specification, all Product registration, licensing, testing, and marking in performance under this Agreement in the areas of: • Product safety including lasers and radio frequency, • Electromagnetic compatibility, • Radio and telecom interconnect, and • Eco-environmental requirements. Supplier shall ensure by means of ongoing reviews/testing and other appropriate action that all the above requirements for the Products to be delivered are fulfilled and documented, and that proof can be provided to Company at any time. The necessary documents for this purpose shall be retained for the life of the Products delivered, and as a minimum, six (6) years from the date of the last delivery to Company. Supplier shall have in place a quality process or program that specifically focuses on maintaining the on-going product safety and regulatory compliance of Products. Any variations or issues found during Product compliance audits by external agencies, bodies or their assigned representatives are to be immediately communicated to the appropriate Company personnel, and resolved to the satisfaction of the Company and agencies involved. The Supplier shall include such variations or issues as found in these inspections into their Quality System Action Register or tracking system. Supplier agrees to conform to any additional Specifications that Company may require in order for Company to meet special and unique requirements set by Company's end customers. In such an event, any additional cost incurred by Supplier to conform to such additional Specification shall be treated by agreement between the Company and Supplier. 31. TL-9000 Supplier will obtain and maintain certifications for TL9000 registered by an accredited Registrar within one (1) year after the execution of this Agreement, for all of Supplier's existing manufacturing and design operations, or within eighteen (18) months for all of Supplier's new manufacturing and design operations, which contribute to the design, development, production, delivery and service of Product where TL9000 is a product requirement. PRODUCT CONFORMANCE. All Products delivered by Flextronics to INFOCUS hereunder shall be in complete conformance with the Product and Process Documentation controlling the procurement, manufacture, test, packaging and preparation for shipment.
