Product Safety. Seller must maintain the state of the product so that it is able to perform to its designed or intended purpose without causing unacceptable risk of harm to a person or damage to property.

BUYER COVENANTS AND AGREES TO TRANSPORT, STORE, HANDLE, USE, DISPOSE OF AND OTHERWISE DEAL WITH PRODUCT SAFELY AND IN STRICT COMPLIANCE WITH ALL LAWS AND REGULATIONS AND ALL APPLICABLE STANDARDS OF CARE, INCLUDING IN A MANNER NO LESS STRINGENT THAN AS SET FORTH IN SELLER’S LABELS, MATERIAL SAFETY DATA SHEETS AND OTHER SAFETY AND HEALTH INFORMATION. Seller does not warrant the safety of the Product or its use, whether alone or in combination with any other substance or in any process or equipment. Buyer assumes all responsibility for warning its employees, customers, and contractors of any hazards associated with the Product, including those arising from incorporation of the Product into other substances or use in process(es). Seller assumes no liability for Xxxxx’s failure to comply with Xxxxx’s obligations under the E.U. REACH (Registration, Evaluation, Authorization, and Restriction of Chemicals) regulations.
Product Safety. The Policy of HII is to provider product and services which: -- Perform their required function safely for their intended use. -- Perform their required function reliably and with minimum adverse effects on the environment. -- Meet or exceed applicable governmental, state and local regulations and industry standards. -- Reduce the risk of injury to persons, property and the environment. -- Are accurately and properly advertised, labeled, promoted, and packaged.
Product Safety. The supplier/organization shall plan, implement, and control the processes needed to assure product safety during the entire product life cycle, as appropriate to the organization and to the product.
Product Safety. 16.1 The Seller will provide all safeguards, and take all precautions, necessary in connection with the production, processing and delivery of the Products to prevent the occurrence of any accident, injury, death, loss, or damage to any person or property.

This process should include the following issues: • Determination of the legal and official product safety requirements • Notification of customers about identified requirements • Determination of characteristics that are relevant for product safety • Defined responsibilities • Appointment of a product safety officer • Identification of training needs within the company • Transmission of product safety requirements throughout the supply chain
Product Safety. Seller (and seller employees) are required to prevent the use of counterfeit parts by the following when applicable: Ensuring that persons are aware of their contribution to product or service conformity, their contribution to product safety, and the importance of ethical behavior.
Product Safety. Each party will be solely responsible for implementing and maintaining its own environmental, health and safety procedures for the handling, storage and use of the Products and any other materials or hazardous waste which may be used or may arise in connection with the use of the Products. The parties will cooperate reasonably and in good faith to ensure employee and public safety.
Product Safety. After the Closing Date, Purchaser shall have all responsibility for investigating and reporting adverse experiences and complaints for the Products, and addressing any FDA inquiries relating to the safety of the Products.
