More Definitions of FOR THE FACILITY

FOR THE FACILITY means the primary market area for the Facility identified in the study prepared by or on behalf of ALS for purposes of determining the feasibility of the Facility and a copy of which has heretofore been furnished to Owner. With respect to any other facility, the "Primary Market Area" shall mean the primary market area identified in any similar study prepared by ALS or any third party for purposes of determining its feasibility. Owner may assign its rights to this covenant not to compete to any purchaser of the Facility. Each of Owner and ALS expressly acknowledges that irreparable loss and injury would result to Owner or ALS (as the case may be) or to a party to whom Owner may have sold the Facility upon the breach of any of the covenants contained in this Section 6.3 and that damages arising out of such breach would be difficult to ascertain.
