Non-Employees. When there are no eligible applicants from employees as set out in the above, or the apprentice openings exceed the number of eligible employees, the company may fill the posting from other sources. Non-Employees. Service performed for the Employer by an individual who is not classified by the Employer as an employee on both payroll and personnel records shall not be considered Recognized Employment. Without limiting the generality of the foregoing, such service shall include service performed by an individual classified by the Employer as a Leased Employee, leased owner, leased manager, shared employee, shared leased employee, temporary worker, independent contractor, contract worker, agency worker, freelance worker or other similar classification.
Non-Employees. Students and College Faculty will not be considered employees or agents of Participating Site for any purpose. Students and College Faculty will not be covered by or entitled to any social security, unemployment compensation, retirement, pension and/or any other benefit program or worker’s compensation program offered or provided by the Participating Site. Participating Site shall not be required to reimburse College for any salary, benefits, or other expenses of Students or College Faculty. To this end, the College shall instruct all students placed with the Participating Site to sign the Acknowledgment Form for Students attached as Exhibit B. Additionally, the College represents that all students placed at the Participating Site are students of the College and that the students’ course of instruction leads to a degree or diploma or that the students are completing clinical training, fellowships, or residence requirements. To the extent the Participating Site generates or maintains educational records related to any participating student, the Participating Site agrees to protect the confidentiality of student records as dictated by the Family Educational Rights and Privacy Act (FERPA) and to not release any records or other information of a student without written consent of the student unless required to do so by law or as to dictated by the terms of this Agreement.
Non-Employees. Notwithstanding any other provision of this Agreement (including the Cover Page or the Project Plan), under no circumstances will VENDOR initiate contact or communication with any MSH User who is not a MSH employee for the purpose of using the technology (e.g. MSH’s patients or other persons who access or use MSH’s facilities or services) during the initial term of this agreement, without MSH’s express prior written consent in each instance.
