Express Limited Warranty. This Section 6.2 sets forth Flextronics’s sole and exclusive warranty and Customer’s sole and exclusive remedies with respect to a breach by Flextronics of such warranty.
Express Limited Warranty. VEM warrants that the Products-will have been manufactured in accordance with Customer’s applicable Specifications and will be free from defects in workmanship for a period of twelve (12) months from the date of shipment. This express limited warranty does not apply to (a) materials consigned or supplied by Customer to VEM; (b) defects resulting from Customer’s Specifications or the design of the Products; (c) Product that has been abused, damaged, altered or misused by any person or entity after title passes to Customer. With respect to first articles, prototypes, pre-production units, test units or other similar Products, VEM makes no representations or warranties whatsoever. Notwithstanding anything else in this Agreement, VEM assumes no liability for or obligation related to the performance, accuracy, specifications, failure to meet specifications or defects of or due to tooling, designs or instructions produced or supplied by Customer and Customer shall be liable for costs or expenses incurred by VEM related thereto. Upon any failure of a Product to comply with the above warranty, VEM’s sole obligation, and Customer’s sole remedy, is for VEM, at its option, to promptly repair or replace such unit and return it to Customer freight prepaid. Customer shall return Products covered by the warranty freight pre-paid after completing a failure report and obtaining a return material authorization number from VEM to be displayed on the shipping container. Customer shall bear all of the risk, and all costs and expenses, associated with Products that have been returned to VEM for which there is no defect found. VEM MAKES NO OTHER WARRANTIES ON THE PRODUCTS, EXPRESS, IMPLIED, STATUTORY, OR IN ANY OTHER PROVISION OF THIS AGREEMENT OR COMMUNICATION WITH CUSTOMER, AND VEM SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 7.0 PAYMENT TERMS, ADDITIONAL COSTS AND PRICE CHANGES

Express Limited Warranty. Compusoft GB Ltd warrants that the software will per- form substantially in accordance with the product manu- al/help section and that the software will be free from defects in materials and workmanship under normal use and service. The purchaser is held responsible to install and test the software within 14 days after receipt. The purchaser is obliged to give written notice of obvious defects in the software to Compusoft GB Ltd within 14 days of detection of any defect. In the case where the purchaser does not fulfil this obligation they will lose any claim under warranty.

Consumer Rights You may have the benefit of certain rights or remedies pursuant to the Trade Practices Act and similar state and territory laws in Australia or the Consumer Guarantees Act in New Zealand or any other applicable law, in respect of which certain liability may not be excluded.

Supplier warrants that: (i) the Products will conform to Buyer's applicable Specifications; (ii) the Products shall be free from material and workmanship defects for a period of XXXX XXX 0 days from the date of shipment; (iii) the Products shall be free and clear of all liens and encumbrances and that Supplier will convey good and marketable title to such Product. With respect to first articles, prototypes, pre-production units or test units manufactured solely for Buyer, Supplier makes no representations or warranties whatsoever. In the event that any Product manufactured shall not be in conformity with the foregoing warranties, Supplier shall, at Supplier's sole expense, replace, repair or correct such Product within twenty (20) business days of receipt of such defective Product. Supplier will replace failed product within two (2) business days when possible using production or buffer inventory. Supplier shall waive any charges to Buyer in order to effect the replacement of such defective Products to Buyer. Supplier agrees to maintain a repair capability for products under warranty. If Supplier is unable to repair, replace or correct such product, then Supplier shall credit Buyer for the purchase price paid by Buyer for such Product. To the extent that Supplier receives warranty coverage on failed components beyond the 365 day warranty period, this warranty will be extended to the Buyer.

Canadian Phytopharmaceuticals Corp. warrants that the Products will conform to A E&E Health Superfranchise A E&E Pharma Corporation (or its nominee)'s applicable Specifications and will be free from defects in workmanship for a period of * from the date of shipment. Canadian Phytopharmaceuticals Corp. shall warrant the materials to the same extent that the manufacturer warrants the materials to Canadian Phytopharmaceuticals Corp. This express limited warranty does not apply to (a) materials consigned or supplied by A E&E Health Superfranchise-A E&E Pharma Corporation (or its nominee) or Canadian Phytopharmaceuticals Corp.; (b) defects resulting from A E&E Health Superfranchise---A E&E Pharma Corporation (or its nominee)'s Specifications or the design of the Products; (c) any other defects not caused by Canadian Phytopharmaceuticals Corp.; or (d) Product that has been abused, damaged, altered or misused (not used as in accordance to the product specification) by any person or entity after title passes to A E&E Health Superfranchise---A E&E Pharma Corporation (or its nominee). With respect to first articles, prototypes, pre-production units, test units or other similar Products, Canadian Phytopharmaceuticals Corp. makes no representations or warranties whatsoever. Express Limited Warranty. The express limited warranty set forth in this Section 1.1, the design warranty set forth in Section 1.2, and the express limited extended warranty set forth in Section 1.3, are BSM’s sole and exclusive warranties and Customer’s sole, and together with Sections 1.4 and 2 below, the exclusive remedies with respect to a breach by BSM of such warranties. Subject to Section 1.3, if applicable, the express limited warranty is as follows:
Express Limited Warranty. Xxxxxxxxx warrants all Products to be free of defects in workmanship or materials and that all Services have been performed in a good and workmanlike manner for a term of three (3) months from the date of the installation of the Products or provision of the Services (the “Warranty Period”). The Customer shall notify Xxxxxxxxx in writing within fifteen (15) days of the discovery of a defect causing the Products or Services to be noncompliant with this express warranty. Any such notice must be received during the Warranty Period in order to be valid. If Xxxxxxxxx, after testing, determines that there is a defect causing the Products or Services to be noncompliant with this express warranty during the Warranty Period, Xxxxxxxxx’x sole responsibility under this express warranty shall be either to repair or replace, at Xxxxxxxxx’x option and expense, any such defective Product or Service. Xxxxxxxxx’x express warranty provided herein is expressly conditioned upon the proper maintenance, care, and use of the Products. Improper maintenance, care, and/or use of the Products will invalidate this express warranty. Notwithstanding anything to the contrary contained in this Section: (i) Customer’s machinery or parts shall not be covered by the express limited warranty provided herein (including but not limited to any items procured or provided by Customer in connection with the Products and/or Services to be delivered hereunder);
