Duration of Suspension. In the event Interconnection Customer suspends work by Interconnected Transmission Owner required under an Interconnection Service Agreement or Interconnection Construction Service Agreement pursuant to this Section 3.4, and has not requested Transmission Provider and the Interconnected Transmission Owner to recommence the work required under the applicable agreement(s) on or before the expiration of the time period allowed under this Section 3.4 following commencement of such suspension, the Interconnection Construction Service Agreement and the Interconnection Service Agreement for the Interconnection Request for which Interconnection Customer suspended work shall be deemed terminated as of the end of such suspension time period. The suspension time shall begin on the date the suspension is requested, or on the date of Interconnection Customer’s written notice of suspension to Transmission Provider, if no effective date was specified.

Duration of Suspension. If, within a period not exceeding 10 working days after the applicant has been served notice of the suspension, the customs authorities have not been informed that proceedings leading to a decision on the merits of the case have been initiated by a party other than the defendant, or that the duly empowered authority has taken provisional measures prolonging the suspension of the release of the goods, the goods shall be released, provided that all other conditions for importation or exportation have been complied with; in appropriate cases, this time-limit may be extended by another 10 working days. If proceedings leading to a decision on the merits of the case have been initiated, a review, including a right to be heard, shall take place upon request of the defendant with a view to deciding, within a reasonable period, whether these measures shall be modified, revoked or confirmed. Notwithstanding the above, where the suspension of the release of goods is carried out or continued in accordance with a provisional judicial measure, the provisions of paragraph 6 of Article 50 shall apply.

Duration of Suspension. If customs authorities have not been informed within 10 working days after serving the notice of suspension, that the right holder has initiated proceedings on the merits of the case or that the authority has taken provisional measures for suspension of the release of goods, the goods shall be released. The time period may be extended for another 10 working days in appropriate cases. If the right holder has initiated a proceeding on the merits of the case, the defendant shall have right to a hearing, to determine whether the suspension should be modified, revoked or confirmed within a reasonable period. Indemnification of the Importer and of the Owner of the Goods: The competent authorities shall have authority to order an applicant to pay the importer, the consignee and the owner of the goods appropriate compensation for any injury caused to them.
