Discipline Review Panel. The parties will use the following disciplinary review panel process with respect to any grievances of suspensions or discharges during the current contract term.

Discipline Review Panel. A Discipline Review Panel will consist of four (4) exempt employees outside the employee’s department: two (2) selected by the Union and two (2) by the Vice President for Student Affairs. None of the four (4) will be in the grievant’s chain of command or department. The four (4) Panel members will select a fifth Panel member from a list of currently employed faculty members who have previously held the position of Xxxx at the College and who were employed on the date of ratification; Human Resource Services will provide a list of such persons upon request. The four (4) Panel members will select the fifth Panel member by an alternate strike method and the party exercising the first strike shall be the winner of a flip of a coin. The Discipline Review Panel members agree to maintain confidentiality regarding the selection process and information disclosed in this process. If changes in employment status cause the number of persons on the list to drop below five (5), the parties will attempt to mutually agree on additions to ensure an adequate number of appropriate persons.

Discipline Review Panel. A. The Panel shall hear appeals in cases involving disciplinary actions, as noted in Section 21.8 above, of permanent employees who have satisfactorily completed their new-hire probationary period.

The Panel shall be composed as follows: Two (2) members shall be appointed by the City Manager, Two (2) members shall be appointed by the PBA and those four (4) members shall appoint the fifth member. The two (2) members appointed by the City Manager shall be chosen from residents of the City of Pembroke Pines and may not be employees of the City. The two (2) members appointed by the PBA must be certified police officers chosen from within the Pembroke Pines Police Department. The fifth member must qualify utilizing one or both of the aforementioned criteria. Members of the Panel shall not be related to employees of the City of Pembroke Pines.

A Committee member shall suffer no loss of earnings for time spent during their regular scheduled working hours in attending grievance meetings with the Hospital up to, but not including arbitration. It shall monitor the clauses of this Agreement which relate to training and ensure all employees have equal access to training.
