INFORMATION DISCLOSED. No information or knowledge, heretofore or hereinafter disclosed to Xxxxxx, in the performance of or in connection with this Purchase Order, shall be deemed to be confidential or proprietary, unless otherwise expressly agreed to in writing by Xxxxxx and so marked by the Seller.

INFORMATION DISCLOSED. Information disclosed to Vendor by DAI contains DAI’s confidential information, which Vendor shall not disclose to any third party (except as required by law) without DAI’s prior written consent. Unless expressly agreed to in writing by DAI, no information or knowledge disclosed to DAI in the performance of or in connection with this PO shall be deemed to be confidential or proprietary and any such information or knowledge shall be free from restrictions as part of the consideration for this PO. Notwithstanding the foregoing, nothing shall restrict or limit the Client’s rights with regard to data, tooling, or designs it owns or has a right to use, including the right to authorize the Vendor’s use of such data, tooling, or designs in direct contracts between the Vendor and the Client. 13. Незважаючи на вищезазначене, ніщо не обмежує права Клієнта щодо даних, інструментарію або дизайну, які йому належать, або які він має право використовувати, у тому числі право санкціонувати використання Постачальником таких даних, інструментарію або дизайну за прямими контрактами між Постачальником і Клієнтом.

No information or knowledge, heretofore or hereafter disclosed to EMC and the performance of or in connection with this Purchase Order, shall be deemed to be confidential or propriety unless otherwise expressly agreed to in writing in EMC and any such information or knowledge shall be free from any restrictions, other than a claim for patent infringement, as part of the consideration for this purchase Order. Seller shall not, without first obtaining consent of EMC, in any manner advertise, publish, or disclose the existence or acceptance of this Purchase Order nor any details connected herewith, or the content of any information or knowledge transmitted by EMC hereunder to any third party.

Information disclosed to Supplier by Abt Associates contains Abt Associates confidential information, which Supplier shall not disclose to any third party (except as required by law) without Abt Associates prior written consent. Unless expressly agreed to in writing by Abt Associates, no information or knowledge disclosed to Abt Associates in the performance of or in connection with this Order shall be deemed to be confidential or proprietary and any such information or knowledge shall be free from restrictions as part of the consideration for this Order. Neither the confidentiality provision contained in the this Agreement, nor confidentiality provisions contained in any existing agreement with Abt Associates Inc. shall be construed to prohibit or otherwise restrict lawful reporting of waste, fraud, or abuse to a designated investigative or law enforcement representative of a federal department or agency authorized to receive such information.
INFORMATION DISCLOSED. The specifications, drawings, designs, manufacturing data and other information transmitted to Seller by CSP in connection with the performance of this order are the property of CSP and may be covered by one or more CSP patents, patent applications or copyrights. Seller will handle all of this in such a manner to insure that it is not used for any purpose detrimental to the interests of CSP. Unless expressly provided in this order or otherwise agreed to in writing by CSP, Seller's disclosure rights regarding products or services related to this order, and information relating thereto shall be limited to any valid copyright thereon or patent Seller may hold covering the manufacture, use and sale of the products or services. 19.
INFORMATION DISCLOSED. All information set out in the specific disclosures to the Disclosure Letter is true and accurate.
INFORMATION DISCLOSED. As of February 23, 2023, (a) all relevant information relating to the Subject Business, including details of (i) all notified claims in respect of the SINT Contracts and the SP Lloyd’x Xxxxxxxs as of the Valuation Date, (ii) incurred developments data through November 30, 2022, and (iii) gross paid development data through January 31, 2023, is included in the Data Room and the contents of the Data Room are accurate, complete and not misleading as at the time they were so provided; and (b) the claims files relating to the Subject Business accessed by the Retrocessionaire on the SP Parties’ systems or provided to the Retrocessionaire in the Data Room were accurate, complete and not misleading as at the time they were so accessed or provided.
INFORMATION DISCLOSED. The specifications, drawings, designs, manufacturing data and other information transmitted to Supplier by HMMA in connection with the performance of this Order (the “Information”) are the confidential property of HMMA and may be covered by one or more HMMA patents, patent applications or copyrights. Supplier will handle all of this information in such a manner to ensure that it is not used for any purpose detrimental to the interests of HMMA. Supplier shall not disclose any such Information to any person or entity without obtaining the prior express written consent of HMMA.
INFORMATION DISCLOSED. Upon execution of this Agreement, Ex-In will furnish the Emptor with all proprietary information and materials in its possession or control related to the Properties including, without limitation, all geological, geophysical, geochemical and other technical information, data, plans, reports, records, studies, drawings, maps, charts, models, logs, calculations, compilations, analyses, evaluations and interpretations (hereinafter the “Information”).
