Specialty Alterations definition

Specialty Alterations means any Alteration or Improvement that is not a normal and customary general office improvement, including, but not limited to improvements which (i) perforate, penetrate or require reinforcement of a floor slab (including, without limitation, interior stairwells or high-density filing or racking systems), (ii) consist of the installation of a raised flooring system, (iii) consist of the installation of a vault or other similar device or system intended to secure the Premises or a portion thereof in a manner that exceeds the level of security necessary for ordinary office space, (iv) involve material plumbing connections (such as, for example but not by way of limitation, kitchens, saunas, showers, and executive bathrooms outside of the Building core and/or special fire safety systems), (v) consist of the dedication of any material portion of the Premises to non-office usage (such as classrooms, bicycle storage rooms or kitchens), or (vi) can be seen from outside the Premises. An open ceiling will not be considered a Specialty Alteration.
Specialty Alterations means Alterations consisting of kitchens, executive bathrooms, raised computer floors, raised floors in server rooms, vaults, affixed shelving systems in libraries, filing systems, internal staircases, dumbwaiters, pneumatic tubes, vertical and horizontal transportation systems, any Alterations which are structural in nature or penetrate any floor slab, and other Alterations of a similar character which are not customary for general office use in non-institutional office buildings in midtown Manhattan. Landlord shall advise Tenant whether an Alteration is a Specialty Alteration at the time that consent to such Specialty Alteration is given by Landlord, provided that Tenant includes, as part of its request for such consent, a statement (in capital letters, twelve (12) point font, boldface type) specifically referencing this subsection and advising Landlord that Landlord is required to make such designation as part of any such consent given by Landlord hereunder. Tenant shall, at Tenant’s cost and expense, remove any Specialty Alteration designated by Landlord, repair any damage to the Premises or the Building due to such removal, cap all electrical, plumbing and waste disposal lines in accordance with sound construction practice and restore the Premises to the condition existing prior to the making of such Specialty Alteration, reasonable wear and tear and damage from casualty excepted. All such work shall be performed in accordance with plans and specifications first approved by Landlord, such approval not to be unreasonably withheld or delayed, and all applicable terms, covenants, and conditions of this Lease. If the Landlord’s insurance premiums increase as a result of any Specialty Alterations, Tenant shall pay each such increase each year as Additional Rent within thirty (30) days after receipt of a xxxx therefore from Landlord.

Examples of Specialty Alterations in a sentence

  • All Specialty Alterations are Above-Building Standard Installations.

  • Specialty Alterations: Alterations which are not standard office installations such as kitchens, executive bathrooms, raised computer floors, computer room installations, supplemental HVAC equipment, safe deposit boxes, vaults, libraries or file rooms requiring reinforcement of floors, internal staircases, slab penetrations, conveyors, dumbwaiters, and other Alterations of a similar character.

More Definitions of Specialty Alterations

Specialty Alterations means both (a) internal staircases (subject to the provisions of Exhibit C), any cooking kitchens that are not standard office installations customarily found in Comparable Buildings (but not any pantries, cafeterias or seating areas), vaults, structural reinforcements (provided that structural reinforcements below the slab shall not be deemed Specialty Alterations if same shall not impact future tenant installations or reduce the useable area of the leasable space below such reinforcements, in each case, except to a de minimis extent), dumbwaiters, conveyors and supplemental HVAC units; and (b) any Alteration that would, as a result of the unique nature of such items or the anticipated difficulty or expense required to remove such items, expose Landlord to additional removal and repair costs to remove such items. If Tenant does not remove any such Designated Specialty Alterations at the end of the Term following written demand therefor by Landlord to Tenant, in addition to its other remedies provided for in this Lease or otherwise under law, Landlord shall have the right to remove the same, and Tenant shall repay Landlord’s actual cost for such removal and for repairing any damage caused by such removal plus Landlord’s Fee within thirty (30) days after delivery of a reasonably detailed invoice therefor. The provisions of this Section 12(g) shall survive termination of this Lease. Notwithstanding anything in this Lease to the contrary, (i) Speciality Alterations shall exclude all Base Building Improvements and cabling and wiring installed by or on behalf of Tenant (the parties agreeing that Tenant shall not be required at any time during or upon the expiration of the Term to remove such cabling or wiring), and (ii) Tenant shall not be obligated to remove any Alterations that is not a Designated Speciality Alterations.
Specialty Alterations means Alterations which are not standard office installations such as kitchens, executive bathrooms, raised computer floors, computer room installations, supplemental HVAC equipment, safe deposit boxes, vaults, libraries or file rooms requiring reinforcement of floors, internal staircases, slab penetrations, conveyors, dumbwaiters, print rooms and model shops, and other Alterations of a similar character.
Specialty Alterations means Alterations that (i) perforate a floor slab in the Premises or a wall that encloses the core of the Building, (ii) require the reinforcement of a floor slab in the Premises, (iii) consist of the installation of a raised flooring system, (iv) consist of the installation of a vault or other similar device or system that is intended to secure the Premises or a portion thereof in a manner that exceeds the level of security that a reasonable Person uses for ordinary office space, or (v) involve material plumbing connections (such as kitchens (other than a customary pantry for warming food) and executive bathrooms outside of the Building core).
Specialty Alterations shall have the meaning set forth in Section 6.1(C).
Specialty Alterations means Alterations consisting of any executive or private lavatories, raised computer floors, vaults, any steel plates or reinforcement installed by Tenant (including without limitation, in connection with libraries or file systems), pneumatic tubes, horizontal transportation systems, and any other Alterations of a similar character to those enumerated in this sentence, and the installation of any equipment outside of the Premises. If Landlord so elects (at Landlord’s sole option), any or all of Specialty Alterations shall remain in the Premises and become the property of Landlord upon the expiration or sooner termination of this Lease. Any election of Landlord to require that Specialty Alterations remain within the Premises upon the termination or expiration of this Lease shall be made in writing by Landlord to Tenant no later than twenty (20) days prior the Expiration Date or within fifteen (15) days after the sooner termination of this Lease, it being understood that (subject to the proviso at the end of this sentence) in the absence of such notice from Landlord, Tenant shall be required to remove all Specialty Alterations from the Premises (in accordance with the terms and provisions of this Lease) upon the expiration or sooner termination of the Term at Tenant’s sole cost and expense; provided, however that, at the time that Tenant requests Landlord’s approval for the performance of any Specialty Alterations under this Lease (or notifies Landlord of Tenant’s performance of any such Specialty Alterations, in the case of Specialty Alterations which do not require Landlord’s consent hereunder), Landlord shall, if Tenant so requests in writing (or may, if Tenant does not so request in writing), notify Tenant within fifteen (15) days after Tenant’s written request of those Specialty Alterations which Landlord will not require Tenant to remove upon the expiration or termination of the Term of this Lease, and, in the event that Landlord identifies any such Specialty Alterations which shall not be removed from the Premises, Tenant shall not remove such Specialty Alterations from the Premises upon the expiration or sooner termination of the Term of this Lease. Tenant’s obligations under this Section 4.2(d) shall survive the expiration or sooner termination of the Term.

Specialty Alterations means any Alteration that is not a general office improvement, including, but not limited to improvements which (i) perforate, penetrate or require reinforcement of a floor slab (including, without limitation, interior stairwells or high-density filing or racking systems), (ii) consist of the installation of a raised flooring system, (iii) consist of the installation of a vault or other similar device or system intended to secure the Leased Premises or a portion thereof in a manner that exceeds the level of security necessary for ordinary office space, (iv) involve material plumbing connections (such as, for example but not by way of limitation, kitchens, saunas, showers, and executive bathrooms outside of the Building core and/or special fire safety systems), (v) consist of the dedication of any material portion of the Leased Premises to non-office usage (such as a cafeteria, bicycle storage rooms or kitchens), (vi) can be seen from outside the Leased Premises, and (vii) require changes to a floor or ceiling, including an internal stairway or atrium area, and which include, without limitation, any floor openings in excess of 200 square feet (whether installed by Landlord (except for openings to comply with code) or Tenant) (the “Floor Openings”), provided, with respect to the restoration of the Floor Openings, Landlord and Tenant shall share equally in the costs of such restoration and Tenant’s obligations for restoration of Floor Openings will not exceed $100,000 (the “Tenant Restoration Reimbursement”). Tenant will not be required to pay the Tenant Restoration Reimbursement until the earlier to occur of (x) six (6) months after the termination of this Lease, or (y) the date on which Landlord executes a lease with another tenant for space that includes the Floor Openings; provided, however, if Landlord leases all or a portion of the Leased Premises that contains Floor Openings to another tenant, and such other tenant desires to keep such Floor Openings in place, Tenant shall not be required to pay for the Tenant Restoration Reimbursement which such tenant desires to keep in place. In connection with the foregoing, Landlord will be entitled to retain $100,000 of the Security Deposit until the Tenant Restoration Reimbursement has been paid in full. If Tenant fails to pay the Tenant Restoration Reimbursement, Landlord shall be entitled to apply such portion of the Security Deposit
