Warranty and Service. Contractor warrants all goods delivered to be free from defects in labor, material and manufacture and to be in compliance with the specifications set out in this Contract. All implied and express warranty provisions of the UCC are hereby incorporated by reference. Further, Contractor represents and warrants that Contractor has the power and authority to enter into and perform this Contract and that this Contract, when executed and delivered, shall be a valid and binding obligation of contractor enforceable in accordance with its terms. All items delivered shall carry either the standard manufacturer’s warranty or service policy providing that warranty work will be performed by any authorized manufacturer's dealer, or if specified in the Specifications, the warranty and service policy called for in the Specifications. In addition, unless otherwise noted in the Specifications, the warranty and service policy indicated above shall include the following terms and conditions:

Warranty and Service. KMC warrants that the Production Instruments and Pilot Instruments manufactured by it will be free, under normal use and maintenance, from defects in material and workmanship for a period of twelve (12) months following installation at Gen-Probe's customer or eighteen (18) months following delivery, whichever is earlier (the "Warranty Period"). (If delay in delivery of any Instrument results solely from action or inaction of Gen-Probe, then the 18-month warranty period for such Instrument shall commence on the scheduled delivery date or on completion of the Instrument by KMC, whichever is later.) Any materials provided by or on behalf of Gen-Probe as customer-furnished material shall be excluded from the warranty provided by KMC under this Section 8.1. As Gen-Probe's sole and exclusive remedy for any defects in KMC manufactured Instruments (provided, however, that nothing contained in this sentence shall affect Gen-Probe's right of indemnity as to third party claims pursuant to Section 9.1), KMC shall, at its option (subject to the reasonable requirements of Gen-Probe's customers as to which KMC has been given notice), reimburse Gen-Probe for the cost of field service (subject to KMC's right to approve such field service costs, pursuant to a standard policy or on an individual basis, before field service is provided), provide factory service of such defective Instrument (without charge to Gen-Probe), or replace the defective Instrument (without charge to Gen-Probe); provided, however, that KMC must be notified in writing by Gen-Probe of the defect within the Warranty Period. As set forth in Section 6.10, KMC shall sell to Gen-Probe an inventory of repair parts to be used by Gen-Probe in performing field service on Instruments. During the Transition Phase, Gen-Probe and KMC shall establish mutually agreed-upon factory service programs, for service both during the Warranty Period and thereafter.
Warranty and Service. All Work performed by Contractor shall be unconditionally warranted to Viewrail and Viewrail’s customer to be free from defects in workmanship for a period of one (1) year from completion of the Work by Contractor (or for such longer period if required by local law). The determination as to what constitutes a defect in workmanship will be within the sole discretion of Viewrail, which discretion shall be reasonably exercised. The repair of defects shall be performed by Contractor within five (5) business days of notification by Viewrail or within such other reasonable time as may be agreed to by Viewrail under the circumstances of the particular situation. Failure of Contractor to make timely repairs hereunder shall entitle Viewrail to cause the correction of such defects to be performed by third parties. Further, the cost of such work, including supervision and overhead expenses, will be charged, or back charged to Contractor. If requested by Viewrail, Contractor will respond directly to Viewrail’s customer’s request for service, and these requests will be handled as if they were requested by Viewrail under the terms and conditions specified herein.
Warranty and Service. Licensee shall provide warranty protection, including but not limited to proper safety instructions and warnings, for the Licensed Products at a level, scope and duration equal to or greater than that offered by competitors for products similar to the Licensed Products. As part of supporting and servicing such warranty and warning obligations, Licensee shall establish and maintain a dedicated brand customer service "800" number for responding to customer inquiries, complaints and other matters to adequately service the purchasers of the Licensed Products during the Initial Term or Renewal Term of this Agreement for one (1) year after termination of this Agreement.

OMSC expressly disclaims all warranties, either expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose, and OMSC neither assumes, nor authorizes any other person to assume for it, any liability in connection with the sale of the vehicle. Warranty and Service. GreenTech’s Product(s) are sold subject only to the applicable printed warranty accompanying the product(s) in effect at the time of sale and such warranty shall be in lieu of all other warranties express or implied. GreenTech makes available for purchase a repair service for products that are out of warranty. Affiliate Dealer or Affiliate Dealer’s customer must contact GreenTech to initiate Out of Warranty Service.
