USE AND SAFETY. Customer acknowledges that it is Customer’s responsibility to provide proper safety devices and equipment to safeguard the user from harm for any particular use, operation or set up, and to adequately safeguard the Product in conformance with all applicable federal, state and local government safety standards and all industry safety standards. Customer shall, at its own expense, defend, indemnify and hold harmless Path1, its agents and employees against any and all third party losses, costs, damages, claims, liabilities or expenses, including but not limited to reasonable attorneysfees and costs arising out of the use or operation of the Product, except for claims for repair or replacement of defective equipment or parts as provided in Section 15 hereof; provided that Path1 is promptly notified in writing of such claim or suit and Path1 shall have sole control of the defense and/or settlement thereof.
USE AND SAFETY. This certifies that I, the Lessee, am experienced and capable in all aspects of the handling and operation of the rental such as the one rented above. ▇▇▇▇▇▇ agrees said rental will not be occupied by a greater number of persons that is shown in said rental. The Lessee certifies that he/she will operate the rental in accordance with all safety rules and regulations as posted in this office or on the vehicle, and further certifies that he/she has read and understands said rules and regulations and will adhere to state laws and regulations. Lessee agrees that its use of the rental is at its own risk. BRL assumes no responsibility for property damage or personal injury to the Lessee or others. BRL requires that Lessee and its guests operate the Rental responsibly by maintaining controllable speeds, keeping a safe distance from other vehicles, people, animals, and marked and unmarked hazards. Deviation from this requirement may result in personal injury and property damage for which Lessee shall be liable. ▇▇▇▇▇▇ agrees not to use, nor permit the use of: a. the rental for any unlawful purpose; b. the rental in a careless or negligent manner; c. the rental while under the influence of liquor, narcotics, or any other drugs; and d. by any other person not the signatory of the agreement. CONDITION, RETURN, AND REPAIR. The Lessee certifies that he/she has examined the rental and equipment and finds it acceptable and suitable for the purpose for which it is leased. ▇▇▇▇▇▇ agrees to report any accident, malfunction or breakdown of rental to lessor immediately. Continued use of the rental shall be entirely at the Lessee’s risk and thus ▇▇▇▇▇▇ assumes all liability of injury and damage to all persons and property that may become involved by its continued use. ▇▇▇▇▇▇ agrees to return the rental in the same condition as when leased, except for reasonable wear and tear. All repairs shall be at Lessee's expense and shall utilize only specified brand parts in such repairs to be agreed upon between Lessee and BRL. Lessee shall be liable for all parts and labor incurred in such repairs, as well as any rental down time experienced by BRL. Failure to return the Rental to the BRL office location will result in forfeiture of ▇▇▇▇▇▇'s rights hereunder and ▇▇▇▇▇▇ shall be solely responsible for the loss of the non-returned rental, notwithstanding any provisions herein to the contrary. USE AND SAFETY. MARINA does not guarantee that electrical service shall be continuous. CUSTOMER shall not use the marina's electrical outlets to operate power tools, equipment, machinery, etc., unless written permission has been given by MARINA. Use of any open flame device, toxic chemicals, or any other hazardous equipment or supplies in the docking area is prohibited. CUSTOMER shall use the docks and attached facilities for reasonable and typical boating activities of a noncommercial nature. CUSTOMER shall keep the dock area clear of all gear, tackle, and other obstructions. CUSTOMER agrees not to dispose of waste or trash (including treated or untr eated sewage from heads or holding tanks) in the lake or docking area. ▇▇▇▇▇▇ shall not permit CUSTOMER to: cause damage to the docking facility through excessive wear and tear, create any unnecessary disturbance or nuisance, or store rubbish on the docking facility and not complying with clean marina guidelines. If CUSTOMER wishes to have someone other than an employee of MARINA work on his boat in the marina, prior written approval must be obtained from MARINA. Such approval will be granted only if ▇▇▇▇▇▇'s service department cannot perform the required repairs to the boat and/or the outside serviceman can deliver to MARINA evidence of a standard certificate of ▇▇▇▇▇▇▇'▇ compensation and liability insurance coverage. CUSTOMER shall deliver to MARINA duplicates of all keys required to access and operate his/her boat. ▇▇▇▇▇▇ shall enter CUSTOMER's boat for periodic inspection or in the event of an emergency. For safety and fire protection, the filling of fuel tanks from transported receptacles will not be permitted. All boats must be properly moored with adequate mooring lines and fenders so as to prevent damage to other boats, docks, or pilings. In the event the mooring lines are not strong enough or improperly tied, MARINA shall have the right, but not the obligation, to replace said lines at the expense of the boat owners. All boats must be equipped with battery ON/OFF switch and have a current/certified fire extinguisher on board. CUSTOMER agrees to pay for the installation of these safety devices if they are not present and/or not in proper working condition. No signs or advertisements allowed "without written authorization” from management.
