REFUELING SERVICE CHARGE. Customer acknowledges that a “Refueling Service Charge” will be applied to all Equipment not returned with a full tank of fuel. The exact cost of the Refueling Service Charge may vary depending on the rate being charged by the Store Location on the date Customer returns the Equipment. Customer acknowledges that the Refueling Service Charge is not a retail sale of fuel. Customer may avoid the Refueling Service Charge if Customer returns the Equipment with a full tank of fuel.
REFUELING SERVICE CHARGE. PC agrees to provide the Equipment to Customer with full fuel tank(s). Customer agrees to return the Equipment with full fuel tank(s). If Customer returns Equipment with fuel tank(s) less than full, Customer will pay to PC an amount based on the per gallon fuel charge on the front of this Agreement in order to fill the fuel tank(s) to full.

If Xxxxxx returns the Equipment with the fuel tanks less than full, Lessee will pay to StoMachine Technology a sum equal to StoMachine Technology’s then applicable refueling service charge posted at the StoMachine Technology branch or Distributor Location from which the Equipment was rented for the number of gallons required to refill the tanks at the time of the return.

Legal Expenses. The Customer will pay to the LRS all of the damages, costs and expenses, including the full amount of all legal fees, accountants and expert witness fees, disbursements, and costs of investigation whether legal proceedings are commenced or not, incurred by the LRS in enforcement of this Agreement. 18. Merger/Modification/Severability. This Agreement (including the front) expresses the entire agreement between the parties with respect to the subject matter hereof. No change, modification or alteration of the terms hereof will be effective as against LRS unless it is in writing and signed by a duly authorized officer of LRS. Customer’s execution of this instrument and/or acceptance of delivery of any part of the Equipment shall constitute Customer’s acceptance of all of the terms and conditions contained herein, and the exclusion of any terms and conditions otherwise stated by Customer or contained in any of Customer’s documents that conflict with or limit the terms contained herein. This Agreement shall be governed and construed by the laws of the state/province in which the Branch is located. Customer consents to jurisdiction in the state and federal courts of such state/province. If any provision is held invalid or unenforceable, the remainder of this Agreement shall not be affected thereby and to this end the provisions of this Agreement are declared to be severable. 19. Obligations to LRS’s Assignee. Customer acknowledges that LRS’s interest in the Equipment and its rights under this Agreement have been assigned to a third party (“Assignee”) to secure obligations of LRS to Assignee.
