Premium Compensation Rate - Overtime Work. The University conforms to the Fair Labor Standards Act (FLSA). All employees shall be compensated at time and one-half (1 1/2) for all hours worked in excess of forty (40) hours. Overtime pay and other premium pay shall not be pyramided. Such overtime hours shall be compensated either by (a) cash, or (b) compensatory time off; at the rate of one and one-half (1 1/2) hours for each hour worked, at the option of the University. For the purpose of computing overtime, all holidays paid for but not worked and hours of paid leave, excluding paid sick time, shall be counted as hours worked. All paid sick time shall not be counted as hours worked for overtime purposes. For twelve hour staff, holiday hours paid for but worked shall be counted for overtime purposes. These hours shall be counted on an hour for hour basis towards the forty (40) hours.

An exempt negotiations unit employee who works a "full day" beyond his/her regular work week shall be granted a comp day for said day provided that the negotiations unit employee notifies his/her supervisor in writing of the operational necessity to work beyond his/her regular work week and receives the supervisor's prior approval to do so. For the purpose of this provision, a "full day" shall be defined as the negotiations unit employee's regular daily hours of work. Comp days may not be earned fractionally. Comp days must be used prior to vacation days and float days and by the end of the quarter following the quarter in which they are earned.

When scheduled to work overtime, staff members are not permitted to call out New Jersey Xxxxxx Xxxx Leave. For twelve-hour staff, holiday hours paid for but worked shall be counted for overtime purposes. These hours shall be counted on an hour for hour basis towards the forty (40) hours.

For the purpose of this provision, a “full day” shall be defined as the employee’s regular daily hours of work. Compensatory time may be earned in half-day increments. Comp days may not be earned fractionally. Compensatory time days must be used prior to vacation, personal, administrative, and mandatory days and float days and by the end of the quarter following the quarter in which they are earned.
