PERSONAL RELATIONSHIP. The perpetrator has or has had a relationship with the employee, e.g., domestic violence in the workplace. Prohibited Behaviour Violence in the Workplace may include, but is not limited to the following list of prohibited behaviours directed at or by a co-worker, manager or member of the public:  Direct threats or physical intimidation  Implications of suggestions of violence  Stalking  Possession of weapons of any kind on ECNG property, including parking lots, other exterior premises or while engaged in activities for ECNG in other locations, or at ECNG – sponsored events, unless such possession or use is a requirement of the job  Assault of any form  Physical restrain, confinement  Dangerous or threatening horseplay  Loud, disruptive or angry behaviour or language that is clearly not part of the typical work environment  Blatant or intentional disregard for the safety or well-being of others  Commission of a violent criminal offence on ECNG property  Any other act that a reasonable person would perceive as constituting a threat of violence Domestic violence, while often originating in the home, can significantly impact workplace safety and the productivity of victims as well as co-workers. For the purposes of this document, “domestic violence” is defined as abuse committed against an adult. Xxxxx is the intentional reckless attempt to cause bodily injury, sexual assault, threatening behaviour, harassment, or stalking; making annoying phone calls to a person who is any of the following relationships:  Spouse or former spouseDomestic partner or former domestic partner  Cohabitant or former cohabitant and/or other household members  A person with whom the victim is having, or has had, a dating or engagement relationship  A person with whom the victim has a child ECNG recognizes that domestic violence may occur in relationships regardless of the marital status, age, race, or sexual orientation of the parties.   • General Relationship Executive shall be considered an employee of the Company within the meaning of all federal, state and local laws and regulations including, but not limited to, laws and regulations governing unemployment insurance, workers’ compensation, industrial accident, labor and taxes.

  • Legal Relationship Nothing in this Agreement is to be construed as creating a partnership, trust arrangement, joint venture, agency, employment relationship or any form of legal relationship between the parties beyond contractual obligations.

  • Commercial Relationship The Employee expressly acknowledges that the Employee’s participation in the Program and the Company’s grant of the Award does not constitute an employment relationship between the Employee and the Company. The Employee has been granted the Award as a consequence of the commercial relationship between the Company and the Company’s Subsidiary in Mexico that employs the Employee, and the Company’s Subsidiary in Mexico is the Employee’s sole employer. Based on the foregoing: (a) the Employee expressly acknowledges that the Program and the benefits derived from participation in the Program do not establish any rights between the Employee and the Subsidiary in Mexico that employs the Employee; (b) the Program and the benefits derived from participation in the Program are not part of the employment conditions and/or benefits provided by the Subsidiary in Mexico that employs the Employee; and (c) any modifications or amendments of the Program or benefits granted thereunder by the Company, or a termination of the Program by the Company, shall not constitute a change or impairment of the terms and conditions of the Employee’s employment with the Subsidiary in Mexico.

  • Confidential Relationship Any information and advice furnished by any party to this Agreement to the other party or parties shall be treated as confidential and shall not be disclosed to third parties without the consent of the other party hereto except as required by law, rule or regulation. The Manager hereby consents to the disclosure to third parties of (i) investment results and other data of the Manager or the Portfolio in connection with providing composite investment results of the Adviser and (ii) investments and transactions of the Manager or the Portfolio in connection with providing composite information of clients of the Adviser.

  • No Employment Relationship Whether or not any Options are to be granted under this Plan shall be exclusively within the discretion of the Plan Administrator, and nothing contained in this Plan shall be construed as giving any person any right to participate under this Plan. The grant of an Option shall in no way constitute any form of agreement or understanding binding on the Company or any Related Company, express or implied, that the Company or any Related Company will employ or contract with an Optionee, for any length of time, nor shall it interfere in any way with the Company’s or, where applicable, a Related Company’s right to terminate Optionee’s employment at any time, which right is hereby reserved.

  • Employment Relationship Employment with the Company is for no specific period of time.   • Consulting Relationship During the term of this Agreement, Consultant will provide consulting services to the Company (the “Services”). Consultant shall use Consultant’s best efforts to perform the Services such that the results are satisfactory to the Company. Any consulting relationship between the Company and Consultant, whether commenced prior to or upon the date of this Agreement, shall be referred to herein as the “Consulting Relationship”.

  • Working Relationship 4.3.1 Where there is a problem in the working relationship between the principal and the Board (including individual Board members) that has not been informally resolved and is to the detriment of the school, the Board, in consultation with the principal, may consider appointing a suitably qualified independent person to mediate or facilitate between the parties and/or undertake an impartial and objective assessment of the concern(s).
