Payment Pending Determination of Claims. An employee who is absent from work as a result of an illness or injury sustained at work and who has been awaiting approval of claim for benefits for a period longer than one (1) complete pay period may apply to the Hospital for payment equivalent to the lesser of the benefit would receive from the Workplace Safety and Insurance Board if claim was approved, or the benefit to which would be entitled under the sick leave plan. Payment will be provided only if the employee provides evidence of disability satisfactory to the Hospital and a written undertaking satisfactory to the Hospital that any payments will be refunded to the Hospital following final determination of the claim by the Workplace Safety and Insurance Board. If the claim for benefits is not approved, the monies paid as an advance will be applied towards the benefits to which the employee would be entitled under the sick leave plan. Any payment under this provision will continue for a maximum of fifteen (15) weeks.

Where a top-up is currently provided from general revenue, it will be provided on the same basis except that it will continue to be provided from general revenue.

The provision of law the penalty is being assessed under and why that provision is most appropriate for that violation. The penalty provision being applied in this case is H&SC section 42402 et seq. because IIT sold, supplied, offered for sale, consumer products for commerce in California in violation of the Consumer Products Regulations (17 CCR section 94507 et seq.).
