OF MANAGEMENT RIGHTS. Save and except any clause in this Collective Agreement, the Management shall have the absolute right to increase or decrease the establishments, to schedule, direct, recruit, discharge, classify, transfer, promote, demote, maintain order, discipline and efficiency and without restricting the generality of the foregoing, select, acquire, install and operate any equipment, plant and machinery as it deems necessary. The said absolute right shall not be exercised in an arbitrary or discriminatory manner, or in a manner which would deprive any employee of their employment, except for just cause.
OF MANAGEMENT RIGHTS. Subject to the terms of this Agreement, the Company reserves the right to maintain order, discipline, and efficiency, and to classify, provided such classification is consistent with the terms of this Collective Agreement, also to promote, demote, and transfer employees, and discipline and discharge employees for just cause. The Company further reserves to itself the undisputed right to operate and manage its business in all respects subject to its obligations herein, and to make and alter from time to time, just and reasonable rules and regulations to be observed by the employees, which rules and regulations shall not be inconsistent with the provisions of this Agreement.

OF MANAGEMENT RIGHTS. The Union acknowledges that the administration and management of all the affairs of the Company is the sole function of the Managers and Officers of the Company save only as restricted herein. While it is the sole function of the management of the Company to maintain discipline, order and efficiency, to hire, discharge, transfer, promote or demote employees, to make, enforce and alter reasonable rules and regulations, a claim of or unjust promotion, demotion or transfer, or ‘a claim of discharge or discipline without reasonable cause, may be the subject of a grievance and dealt with as hereinafter provided. Any change in rules and regulations to be observed by employees shall be negotiated by the parties.

Hire, discharge, classify, direct, transfer, promote, lay off and demote, subject to the provisions of this Agreement. Suspend or otherwise discipline employees for just cause. Generally to manage the industrial enterprise in which the Company is engaged and, without restricting the generality of the foregoing, to determine the products to be manufactured, the methods of manufacturing, schedules of production, kinds and locations of equipment to be used, processes of manufacturing, the formulation of its products, to determine and establish standards of performance for all equipment and operation, and the extension, limitation, curtailment or cessation operations. The Company agrees that these functions will be exercised in a manner consistent with the provisions of this Agreement.
OF MANAGEMENT RIGHTS. The Union acknowledges that it is the exclusive function of the Company to: Maintain order, discipline and efficiency. Hire. promote, demote, transfer, reclassify. discipline or suspend employees. to discharge any employee for proper cause, provided that a claim by an employee who has acquired seniority that he has been discharged without proper cause may be the subject of a grievance and dealt with as provided in clause of this Agreement. Operate and manage its business in all respects in accordance with its commitments and responsibilities and in pursuance of its policies; decide on the number of employees needed in any classification; establish job qualifications; determine the location of plants, the product to be manufactured, the schedules of production and sales; decide on the methods, processes and means of manufacturing and distributing and on the extension, curtailment or cessation of operations. The Company agrees that the exercise of the above functions shall not be inconsistent with the provisions of this Agreement.

Subject to the terms and provisions of this Agreement, and provided that the functions, rights and authority of Management are exercised in a just and reasonable manner, the Union acknowledges that it is the exclusive function of the Company to: Maintain order, discipline and efficiency. Hire, discharge, promote, demote, transfer, classify or discipline employees, provided that a claim of a discriminatory classification, promotion, demotion, transfer or claim that an employee has been discharged or disciplined without reasonable cause may be the subject of a grievance and dealt with as hereinafter provided. Exercise any of the rights, powers, functions or authority which the Company had prior to the signing of this Agreement except as those rights, powers, functions or authority are specifically abridged or modified by this Agreement, and without restricting the generality of the foregoing the Company retains the right to determine the number and locations of plants, the products to be manufactured, methods of manufacturing, schedules of production, schedules of work, ARTICLE CONTINUED RESERVATION OF MANAGEMENT RIGHTS Continued quality and quantity standards, kinds and locations of machines and tools to be used, processes of manufacturing and assembling, the engineering and designing of its products, and the control of materials and parts to be incorporated in the products produced.
